دخيلي نبيلتحت إشراف أ. طالب محمد كريم2025-09-222021-09-07M599https://dspace.cu-maghnia.dz/handle/123456789/3247ملخص لحماية الأعوان الاقتصاديين فيما بينهم و هؤلاء و المستهلكين ،و تكريس قواعد و مبادئ نزاهة الممارسات التجارية و هو ما يتجلى من خلال أحكام القانون 04-02 المحدد لقواعد المطبقة على الممارسات التجارية. قد تم معالجة البيوع الممنوعة و الاستثناءات الواردة عليها في تبيان مفهومها ،شروطها ، صورها، ، و الجهات المكلفة بالتحقيق و المتابعة للمخالفين وتسليط العقوبات عليهم.و قد توصلنا على أن نجاعة القوانين لا تكفي لوحدها في مكافحة جرائم البيع إذا كانت الإجراءات تطبيق هذا القانون غير فعالة نظرا لتزايد عدد المخالفات. Résumé Afin de protéger les agents économiques entre ceux ,ceux-ci et les consommateurs, et de consacrer les règles et principes d’intégrité des pratiques commerciales, qui ressort des dispositions de la loi 04-02 applicable aux pactes commerciaux , les ventes interdites et les exceptions qui y sont contenues ont été traité avec en montrant leur concept, condition , image , et les autorités chargées de l’enquête et du suivi des contrevenants Et l’imposition de sanctions. Et nous avons conclu que l’efficacité des lois seuls ne suffit pas pour lutter contre les crimes malhonnêtes, si les procédures d’application de cette loi sont inefficaces en raison du nombre croisant de violations. Abstract To protect the economic agents among themselves, these and consumers, and to devote the rules and principles of intégrité of the business practices, which is evident through the provisions of the law 04-02 applicable to commercial pacts, the prohibited sales and the exceptions contained there in have been addressed in showing their concept, conditions, and images, and the authorities in charge of investigation and follow-up to violators. And the imposition of penalities,and we have conclude that the effectiveness of laws alone is not sufficient in combating dishonest crimes, if the procedures for implementing this law are ineffective due to the increasing number of violations.
