Résumé : Notre recherche est un résumé simple du pouvoir discrétionnaire du juge des affaires familiales relatif aux divorces. Tout cela on se basant sur les textes juridiques du code de la famille Algérien ainsi que de l'avis des experts, de la jurisprudence et des décisions judiciaires. Espérant que cela soit benifique aux étudiants spécialisés et non spécialisés, vu la nature qui caractérise cette loi par rapport aux autres textes de lois. Et le statut immense dont jouit la famille Algérienne au sein de la société et du rôle exercé par le magistrat dans ce domaine-là. ABSTRACT : Our Research is based on deep explanation of Discretion Power of Judge in Family affairs of divorce, counting on the legal text that are specifically related to the Family Algerian law. Exposing some Julistic and legal opinions adding to this the efforts and Justice orders hoping that specialist and non specialist students would have the chance to benefit of it.
