بن سلطان أسماءتحت إشراف أ. مجدوب عبد الحليم2025-09-182021-03-21M578https://dspace.cu-maghnia.dz/handle/123456789/3230الملخص: إن الرقابة القضائية على الصفقات العمومية توضح لنا مدى حرص المشرع الجزائري حماية الصفقات العمومية من جميع أشكال الفساد، باعتبارها أهم مسار تتحرك فيه الأموال العمومية، وذلك من خلال الدور المسند للقاضي الإداري و الذي يهدف إلى احترام مبدأ المشروعية سواء عن طريق قضاء الإلغاء، قضاء الاستعجال أو القضاء الكامل بهدف تحقيق المصلحة العامة، فهو صاحب الاختصاص الأصيل في منازعات الصفقات العمومية . إضافة إلى اختصاص القاضي الجزائي من خلال تجريمه للأعمال التي تكتسي طابعا جزائيا، ووضع آليات للكشف عنها ومكافحتها لحماية المال العام، وهذا دون تجاوز الدور الأصيل للقاضي الإداري في هذا المجال. Abstract : The judicial control of public deals reveal to us the extent to theAlgerian legislator is keen to protect public deals from all forms ofcorruption, considering it the most important course where public funds move, through the role of the administrative judge, which aims to respect the principle of legality, whether by canceling, The urgency judiciary or the complete elimination to achieve the public interest, because he is the original specialist in a disputes of public deals. In addition to the jurisdiction of the criminal judge by criminalizing the acts that are criminal character, and putingthe mechanisms to detect and combat them for protecting the public funds, without exceeding the original role of the administrative judge in this area. Sommaire Le contrôle judiciaire des marchés publics nous montre à quel point le législateur algérien tient à protéger les marchés publics de toutes les formes de corruption, car c'est la voie la plus importante dans laquelle l'argent circule. Le public, à travers le rôle assigné au juge administratif, qui vise à respecter le principe de légalité, que ce soit par le biais du pouvoir judiciaire d'annulation, de jugement urgent ou de justice complète afin de réaliser l'intérêt public, puisqu'il est propriétaire de la juridiction d'origine dans les litiges relatifs aux marchés publics.
