غالي ربيعةتحت إشراف أ. مراد نعوم2025-09-072020-12-02M557https://dspace.cu-maghnia.dz/handle/123456789/3208ملخص: يعتبر موضوع الإهمال العائلي في قانون العقوبات الجزائري من المواضيع المهمة كون هذه الجريمة ذات الوصف الجنحي تمس أمن وإستقرار وسلامة الأسر وهذا الإهمال يقع من الزوج بصفة خاصة بإعتباره صاحب السلطة الأبوية ومن الأم بإعتبارها الوصية على الأبناء بعد وفاة الأب،والإهمال سلوك سلبي ناتج إخلال الجاني بواجباته سواء بقصد أو بغير قصد وقد نص على هذه الجريمة في قانون العقوبات في القسم الخامس ترك الأسرة في المواد 330و330 مكرر،331،332 وله عدة صور ففي الجرائم المشروطة نجد جريمتي ترك مقر الأسرة التخلي عن الزوجة وممارسة الإكراه والتخويف عليها وفي الجرائم غير المشروطة نجد جريمتي عدم تسديد النفقة والإهمال المعنوي للأولاد. RESUME: La négligence familiale est un sujet important du Code pénal algérien, car ce crime, qui constitue un délit, porte atteinte à la sécurité et à la stabilité des familles. Cette négligence est commise notamment par le mari, titulaire de l'autorité parentale, et par la mère, tutrice des enfants après le décès du père. La négligence est un comportement négatif résultant du manquement de l'auteur à ses devoirs, intentionnel ou non. Ce crime est prévu dans le Code pénal, section cinq, « Abandon de famille », aux articles 330, 330 bis, 331 et 332. Il revêt plusieurs formes. Parmi les crimes conditionnels, on trouve le fait de quitter le domicile familial, d'abandonner l'épouse et de faire usage de coercition et d'intimidation à son égard. Parmi les crimes inconditionnels, on trouve le défaut de paiement de pension alimentaire et la négligence morale envers les enfants. Summary: Family neglect is an important topic in the Algerian Penal Code, as this crime, which is a misdemeanor, affects the security, stability, and safety of families. This neglect is committed by the husband in particular, as he has parental authority, and by the mother, as she is the guardian of the children after the father’s death.
