عيساني سميرتحت إشراف أ. ميساوي حنان2025-07-012020-11-26M475https://dspace.cu-maghnia.dz/handle/123456789/2877يعتبر رئيس المجلس الشعبي البلدي المسؤول الأول عن البلدية و هذه الأخيرة هي اللبنة الأساسية في التنظيم الإداري في الدولةّ،و نظرا لقرب رئيس البلدية من المواطن و مختلف المشاكل المحيطة به يستدعي تدخله في مختلف المجالات خاصة حماية البيئة لاعتبارها شأنا محليا. تم تزويد رئيس المجلس الشعبي البلدي في إطار تدخله لحماية البيئة في الجزائر بجملة من الوسائل القانونية التي تتعلق أساسا بمنع حدوث الأضرار البيئية،و تلك التي يتدخل بها بعديا من اجل إزالة التلوث و ردع الملوثين رغم أهمية دور رئيس البلدية في حماية البيئة إلا أنه يصطدم بوجود عراقيل تتعلق بقصور الإطار القانوني، فضلا عن حدود ذات طابع عملي تحول دون تجسيد دوره ميدانيا على أحسن وجه. Résumé Le président de l'assemblée populaire communale est le premier responsable de la commune.Selon la loi Algérienne, la commune représente la collectivité territoriale de base de l'État, et compte tenu de la proximité du maire avec le citoyen et des différents problèmes qui l'entourent, il appelle à son intervention dans divers domaines, notamment la protection de l'environnement, car il s'agit d'une affaire locale. Dans le cadre de son intervention pour la protection de l'environnement en Algérie, le président de l'Assemblée populaire communale s'est vu attribuer un ensemble de prérogatives juridiques qui concernent principalement la prévention des atteintes à l'environnement, et ceux qu'il interfère en dimension afin d'éliminer la pollution et de dissuader les pollueurs. Malgré l’importance du rôle du maire dans la protection de l’environnement, il se heurte à la présence d’obstacles liés à l’insuffisance du cadre juridique, ainsi qu’à des limites empêchent de mieux incarner son rôle. Abstract : The president of the communal popular assembly is the first person in charge of the commune. According to the Algerian law, the commune represents the basic territorial collectivity of the State, and taking into account the proximity of the mayor with the citizen and the various problems which face him, give an obligation for his intervention in various fields, particularly in the domain related with the environment protection because it is considered as a local matter. As part of his intervention for the protection of the environment in Algeria, the president of the Communal People's Assembly was given a set of legal prerogatives which mainly concern the prevention of damage to the environment and those that it interferes in dimension in order to eliminate pollution and to dissuade polluters.
