Le ministère public est une division du pouvoir judiciaire de la société et représente l’intérêt public, et garantit la bonne application du droit. A un rôle limité à jouer dans le transfert du plaidoyer public vers le pouvoir judiciaire jusqu’à un développement et élargissement de l’amendement du Code de la famille qui devient un statut juridique, puis intervient dans les affaires familiales en tant qu’une partie original ou un organisme conformé à l’article 3 bis du Code algérien de la famille.
