شريفي محمد أمين تحت اشراف الاستاذة بلمختار سعاد2025-05-292021-10-20M 0656https://dspace.cu-maghnia.dz/handle/123456789/2572ملخص: يعالج موضوع "آليات حماية البيئة ودورها في تحقيق التنمية المستدامة" فكرة العلاقة بين البيئة والتنمية من حيث الآليات القانونية الكفيلة بتحقيق التوازن بين متطلبات التنمية من جهة ومتطلبات حماية البيئة من جهة أخرى، ذلك أن التنمية إنما تقوم على استغلال الموارد البيئية والثروات الطبيعية، وهذا الاستغلال يؤدي في غالب الأحيان إلى حدوث تدهور يصيب هذه الموارد وهذه الثروات. تمارس هذه الآليات من طرف هيئات على المستوى المركزي وعلى المستوى المحلي، والإدارة مقيدة في ممارسة هذه الآليات فالقانون هو الذي يحدد شروط وخصائص ممارستها. فتتنوع هذه الآليات بين آليات وقائية تمارس قبل مزاولة النشاط وآليات ردعية تمارس أثناء مزاولة النشاط، هذا فضلا عن إقرار نظام للمسؤولية ويلتزم بمقتضاه من ألحق ضررا بالبيئة بالتعويض عنه، والذي يكون في شكل تعويض عيني أو نقدي يقره القاضي، إضافة إلى تعزيز الجانب الجنائي بنظام ردعي صارم ضد الاعتداءات البيئية، وأخيرا كل هذا من أجل ضمان حماية البيئة. Résumé: Le thème de recherche «Les mécanismes de protection de l'environnement et leurs rôles dans le développement durable» est consacré à l'étude de la relation entre l'environnement et développement à travers les instruments juridiques qui veillent au respect de l'équilibre entre le développement d'une part et les exigences de protection de l'environnement d'autre part. Les mécanismes de la protection s'exercent par des organismes centraux et locaux, lesquels doivent respecter textes juridiques qui les encadrent. L'application des mécanismes de protection de l'environnement est subdivisée en deux types de mécanismes ; les mécanismes de prévention qui s'exercent avant le commencement de l'activité, et les mécanismes de dissuasion qui s'exercent durant et après l'activité. En plus des mécanismes citées ci-dessus, une responsabilité (civile, pénale et / ou administrative) est engagée contre toute personne causant un préjudice à l'environnement, et cette dernière doit assumer une compensation en nature ou en espèce approuvée par le juge. Sans oublier la protection pénale de l'environnement qui est assurée par un système répressif stricte qui réprime toute agression contre l'environnement. Summary: The research theme "Environmental protection mechanisms and their roles in sustainable development" is devoted to the study of the relationship between the environment and development through legal instruments that ensure respect for the balance between developments on the one hand and environmental protection requirements on the other. The protection mechanisms are exercised by central and local bodies, which must comply with the legal texts which frame them. The application of environmental protection mechanisms is subdivided into two types of mechanisms; the preventive mechanisms which operate before the start of the activity, and the deterrent mechanisms which operate during and after the activity.
