يحياوي نعيمةتحت إشراف الأستاذ الحاج علي بدر الدين2025-07-032025-07-03M1125https://dspace.cu-maghnia.dz/handle/123456789/2908الملخص: سعت الجزائر في الآونة الأخيرة إلى تفعيل عدّة آليات رقابية لمواجهة ظاهرة الفساد، وفي سبيل تحقيق ذلك استحدثت الهيئة الوطنية لمكافحة الفساد تجسيدا للاتفاقيات الإقليمية و الدولية المبرمة، وتماشيا مع القوانين الداخليّة سيما ما تعلّق منها بالقانون 06/01 المتعلق بالوقاية من الفساد ومكافحته، ولأجل تفادي الاختلالات التي انتابت النظام القانوني للهيئة والتي حالت دون تحقيق المطلوب، تم استحداث آلية مؤسساتية تسمى السلطة العليا للشفافية و الوقاية من الفساد و مكافحته بموجب التعديل الدستوري سنة 2020 و القانون رقم 22/08، كهيئة رقابية مستقلة، رصد لها نظام قانوني مميّز يسمح لها التصدّي لظاهرة الفساد من خلال منحها صلاحية وضع استراتيجية وطنية تتضمن تدابير وقائية شاملة، مع تمتّعها بصلاحية رقابة مدى تنفيذ توصياتها التي تكون متبوعة بأوامر، وكذا إمكانية إحالة الوقائع الجزائية إلى القضاء، حيث سعى المشرع من خلالها إلى توسيع الآليات الرّقابية التي من شأنها تحقيق أعلى مؤشرات النزاهة و الشفافية في تسيير الشؤون العمومية، لكن رغم ذلك تعدّ الامتيازات المعهودة إلى السلطة العليا مبتورة الفعالية بحكم نسبية استقلاليتها، وعدم تمتعها بضمانات فعّالة تكفل لها مدى إعمال تدابيرها. Summary: Recently, Algeria has resorted to many oversight mechanisms to confront the phenomenon of corruption. To achieve this, national mechanisms have been adopted to combat corruption, aligned with regional and international agreements and national internal laws, particularly those related to law 06/01 concerning the prevention and fight against corruption. To avoid shortcomings that appeared in the previous oversight system, which failed to achieve the required goals, an institutional mechanisms called the high Authority for transparency, prevention, and fight against corruption was established. This was done in accordance with the constitutional amen dance of 2020 and law no. 22/08, as an independent oversight body with legal status. This new body allows for the fight against corruption by granting it broad powers in prevention, monitoring, and raising awareness, whilemaintaining independence and neutrality. However, the practical reality revealed the limited effectiveness of this authority due to the lack of real judicial effectiveness in pursuing crimes of corruption and holding the perpetrators accountable. This necessitates a serious review of the applicable laws and the activation of the judiciary’s role in prosecuting corruption cases and imposing appropriate penalties to deter others. Résumé : L’Algérie a récemment eu recours à de nombreux mécanismes de contrôle pour faire face au phénomène de la corruption. A cette fin, elle a adopté des mécanismes nationaux de lutte contre la corruption, en conformité avec les corruptions, en conformité avec les conventions régionales et internationales pertinentes, ainsi que les lois internes nationales, notamment celles relatives à la loi 06/01 sur la prévention et la lutte contre la corruption. Afin d’évité les lacunes révélées par le système de contrôle précédent, qui n’a pas atteint les objectifs escomptés, un mécanisme institutionnel a été mise en place : L’Autorité supérieure de transparence, de prévention et de lutte contre la corruption. Celle-ci a été créée suite à la révision constitutionnelle de 2020 et à la loi n°22/08, en tant qu’organe permet de lutter contre la corruption en lui conférant des compétences étendues en matière de prévention, de surveillance et de sensibilisation, tout en assurant son indépendance et sa neutralité. Cependant, la réalité pratique a révélé une efficacité limitée de cette autorité, notamment en raison du manque d’efficacité judicaire réelle dans la poursuite des affaires de corruption et la sanction des auteurs.
