دحمان عماريةتحت إشراف أ. ديب فاطنة2025-07-142020-12-02M506https://dspace.cu-maghnia.dz/handle/123456789/3108ملخص : يعتبر الطعن بالنقض من الطرق الغير العادية ، و هو يشكل ضمانة فعلية لتحقيق العدالة ، من خلال مراجعة الأحكام و القرارات القضائية النهائية ، وفي المادة الإدارية يمارس الطعن بالنقض أمام مجلس الدولة بصفته محكمة قانون تضطلع بتقويم أعمال الجهات القضائية الإدارية الممثلة في القرارات الصادرة نهائيا عن المحاكم الإدارية و كذلك الأقضية الإدارية المتخصصة (مجلس المحاسبة - لجان الطعن الوطنية ) لتنحصر وظيفته في إما الحكم بقبول الطعن أو رفضه أو نقض الحكم وإحالته لإعادة النظر فيه أو نقض الحكم و الفصل في الموضوع دون إحالة Résumé : Le recours en cassation est considéré comme une méthode extraordinaire, et il constitue une garantie efficace pour obtenir justice, à travers le réexamen des décisions et jugements judiciaires définitifs. Dans l'article administratif, le pourvoi en cassation est exercé devant le Conseil d'Etat en sa qualité de juge qui procède à l'évaluation des actions des instances judiciaires administratives représentées dans les décisions rendues par les tribunaux administratifs ainsi que les arrondissements administratifs spécialisés (Conseil comptable Comités nationaux de recours).
