الملخص: يعتبر المعيار العضوي كأساس لتحديد النزاع الإداري في القانون الجزائري، والذي يرتكز على أن يكون أحد أطراف النزاع شخص معنوي عام، والوارد ذكرهم على سبيل الحصر في نص المادة 800 من قانون الإجراءات المدنية والإدارية، وهم: الدولة أو الولاية أو البلدية أو المؤسسات العمومية ذات الصبغة الإدارية. هذا وقد استعان المشرع الجزائري بمعيار تكميلي لتحديد النزاع الإداري، وهو المعيار الموضوعي الذي يعتمد على طبيعة النشاط أو العمل الإداري Sommaire: La nome organique est considérée comme une base pour déterliner le différend administratif en droit algérien, qui se concentre sur l'une des parties au conflit comme une entité juridique publique mentionnées exclusivement dans le texte de 800 après code de procédures civiles et administratives Ou: l'Etat, la municipalité ou les institution publique a caractère administratif.
