الضمانات القانونية للمستثمر في العقار الصناعي في القانون الجزائري

الملخص تعالج الأطروحة، من خلال تحليل قانوني معمّق، المنظومة التشريعية المؤطِّرة لحماية المستثمر في مجال العقار الصناعي بالجزائر، في ظل التحوّلات الإصلاحية الجوهرية التي أقرّها المشرّع الجزائري، بالنظر إلى الأهمية الاستراتيجية التي يكتسيها الاستثمار في العقار الصناعي باعتباره ركيزة أساسية لدعم الاستثمار المنتج، وتعزيز النسيج الصناعي، وتحقيق التنمية الاقتصادية المستدامة. وتنصرف إلى تفكيك وتقييم نجاعة الضمانات الموضوعية والإجرائية، مع إيلاء عناية خاصة لآلية الامتياز العقاري القابل للتحوّل إلى التنازل بما يعزّز قابلية الاستثمار للاستقرار ويكرّس الأمن القانوني للمشاريع الصناعية، وتخلص الأطروحة إلى أنّ فعالية هذه المنظومة تظل مشروطة بحسن تفعيلها ضمن مقاربة حوكمة رشيدة، كفيلة بإرساء مناخ استثماري مستقر وتنمية استثمارية مستدامة ومتوازنة. Abstract Through an in-depth legal analysis, this dissertation examines the legislative framework governing the protection of investors in industrial real estate in Algeria, in light of the far-reaching reform dynamics introduced by the Algerian legislature, given the strategic importance of industrial land as a fundamental lever for promoting productive investment, strengthening the industrial fabric and achieving sustainable economic development. It undertakes a critical assessment of the effectiveness of both substantive and procedural safeguards, with particular emphasis on the mechanism of the real estate concession convertible into assignment, as a legal instrument capable of enhancing investment stability and consolidating legal certainty for industrial projects. The dissertation ultimately concludes that the effectiveness of this protective framework remains contingent upon its proper implementation within a sound governance approach, capable of fostering a stable investment climate and ensuring balanced and sustainable investment-driven development. Résumé La thèse examine, à travers une analyse juridique approfondie, le cadre législatif régissant la protection de l’investisseur dans le domaine du foncier industriel en Algérie, à la lumière des profondes réformes engagées par le législateur algérien, eu égard à l’importance stratégique que revêt l’investissement dans le foncier industriel en tant que levier essentiel de la promotion de l’investissement productif, du renforcement du tissu industriel et de la réalisation du développement économique durable. Elle procède à une analyse et à une évaluation de l’effectivité des garanties matérielles et procédurales, en accordant une attention particulière au mécanisme de la concession foncière convertible en cession, en tant qu’outil juridique de nature à renforcer la stabilité de l’investissement et à consacrer la sécurité juridique des projets industriels. La thèse conclut, en définitive, que l’efficacité de ce dispositif demeure conditionnée par la qualité de sa mise en œuvre dans le cadre d’une approche de bonne gouvernance, à même d’instaurer un climat d’investissement stable et de promouvoir un développement de l’investissement durable et équilibré.

صورة الآخر في الشعر الجزائري المعاصر مفدي زكرياء نموذجا

الملخص: إن بحثنا هذا يندرج ضمن دراسة حديثة ترمي إلى الغوص في أعماق شعر أحد عمالقة الأدب الجزائريين - مفدي زكريا ، والكشف عن مكان التأثير والتأثر المحيطة بشعره استنادا إلى ما يمليه الأدب المقارن من قواعد ونظريات وفق المناهج الحديثة المعتمدة، وقد وقع اختيارنا في الشق التطبيقي على أهم أعمال الشاعر الجزائري مفدي زكريا شاعر ثورة التحرير المظفرة إحدى أهم محطات تاريخ الأدب الجزائري، لما له من دور وفضل في استرداد الشعب الجزائري لحريته وكذا في محاولة منا لإعطاء شاعرنا حيرا يستحقه من الدراسة الأدبية والنقدية فاخترناه أنموذج دراسة من حيث صورة الآخر في نتاجه الأدبي، وإذا كان الشاعر مفدي زكريا قدر افق ثوره التحرير وسجل بطولات المجاهدين فإنه لا يزال يشكل أحد أهم مقومات الدولة الجزائرية العصرية. Abstract: This research is part of a recent study that aims to delve into the poetry of one of the giants of Algerian literature – Mufdi Zakaria – and to uncover the influences and impacts surrounding his work, based on the rules and theories of comparative literature and its modern methodologies. For the applied section, we have chosen the most important works of the Algerian poet Mufdi Zakaria, the poet of the victorious War of Liberation – one of the most important milestones in the history of Algerian literature – due to his role and contribution to the Algerian people's regaining their freedom. We also seek to give our poet the literary and critical attention he deserves, choosing him as a case study in terms of the image of the "other" in his literary output. While Mufdi Zakaria accompanied the War of Liberation and documented the heroism of the freedom fighters, he remains one of the most important pillars of the modern Algerian state.

مصطلح الرواية العائلية وتطبيقاته في النقد المغاربي المعاص؛ دراسة في نماذج

يتناول البحث دراسة تحليلية، ترصد تمثلات تطبيق مصطلح "الزواية العائلية " على المتن السردي في المغرب العربي، وتتتبع في الوقت نفسه آليات ووسائل اشتغاله في الخطاب النقدي، ومحلّلا كيفيات تمثيله للعلاقات العائلية بوصفها بنية دالة داخل النّصوص الروائية ، تنفتح على أسئلة الهوية والسلطة والذاكرة، وقد استلزم ذلك الوقوف على الكثير من النماذج النقدية التطبيقية لنقاد مغاربة، والتي ساهمت تجاربهم في الكشف عن حقائق النصوص، وعلاقة الروائي بالعائلي، كما كشفت هذه الدراسة مدى تمكن النّقاد المغاربة من تفكيك البنية العائلية داخل المتن السردي، مستفيدين في مقارباتهم على المرجعيات النظرية للتحليل النفسي في أوروبا. This research aims at analyzing and detecting that montors of appliying of the rep- resentation of the term “ family novel”, in the narrative text in the Maghreb, and at the same time, it spreads the mechanisms and means of its operation in critical discourse, and analyzes how it represents family relations and expands them as a significant struc- ture within the narrative texts ,opening up to questions of atmosphere, authority, and memory , this necessitated examining many applied critical models, the meeting of Moroccans, and their experiences contributed to revealing the facts of the text and the relationship between the novelist and the family , this study also revealed the extent to which Moroccan critics were able to deconstruct the family structure wihin narrative text , relying in their approaches on the theoretical references of psychoanalysis in Eu- rope ..
