السلطة التقديرية للإدارة وأثرها على ممارسة الحقوق والحريات (دراسة مقارنة)

ملخص:
من المعلوم أن الإدارة تزاول نشاطها الإداري بوسائلها القانونية في سبيل الحفاظ على النظام العام، وقد تصدر قراراتها الإدارية وفقا لسلطتها التقديرية، والتي لايجب أن تميل أو تنحرف عن نطاق المشروعية. والإدارة وحتى وهي بصدد ممارسة أعمالها المشروعة وفقا لسلطتها التقديرية، قد تصطدم مع ما تكفله المواثيق الدولية والدساتير من حماية للحقوق والحريات وضمانتها، وذلك بتقييد هذه الحقوق والحريات وحتى الضمانات المقررة لها بحجة الحفاظ على النظام العام. وهنا يأتي دور القضاء الإداري الموضوعي والقضاء الإداري الاستعجالي من خلال ممارسته للرقابة على القرارات التي تصدرها الإدارة وفقا لسلطتها التقديرية، بفحص وتقدير مدى مشروعية ومدى تناسب الإجراء المتخذ، مع القيد المتخذ.
Résumé:
Il est bien connu que l'administration exerce son activité administrative par ses moyens légaux en vue de préserver l'ordre public. Dans ce sens, elle prend des décisions administratives, conformément à son pouvoir discrétionnaire, qui ne doit ni dévier ni s'écarter du cadre de la légalité. Or, l'administration, même lorsqu'elle exerce ses activités légitimes conformément à son pouvoir discrétionnaire, peut entrer en collision avec les protections accordées par les pactes internationaux et les constitutions en matière de droits et libertés fondamentales ainsi que leurs garanties, en restreignant ces droits et libertés, voire les garanties qui leur sont prévues, au nom de la préservation de l'ordre public. C'est ici qu'intervient le rôle du juge administratif objectif et du juge administratif des référés, par l'exercice de son contrôle sur les décisions prises par l'administration dans le cadre de son pouvoir discrétionnaire, en examinant et en appréciant le degré de légalité ainsi que la proportionnalité de la mesure adoptée et de la restriction imposée.
Abstract:
It is well known that the administration exercises its administrative activity through its legal means in order to preserve public order. It thus issues its administrative decisions, pursuant to its discretionary power, which must not deviate or stray from the scope of legality. However, the administration, even when carrying out its legitimate acts in accordance with its discretionary power, may collide with the protections afforded by international covenants and constitutions for rights and freedoms and their guarantees, by restricting these rights and freedoms—and even the guarantees provided for them—under the pretext of preserving public order. Here lies the role of the objective administrative judge and the emergency administrative judge, through the exercise of control over the decisions issued by the administration pursuant to its discretionary power, by examining and assessing the degree of legality as well as the proportionality of the measure taken and the restriction imposed.

تتناول هذه المطبوعة مدخلًا شاملًا إلى لسانيات التراث، بدءًا من الدراسات التمهيدية حول اللغات عند الأمم القديمة، مرورًا بالسباق التاريخي للعرب في الدراسات اللغوية، وصولًا إلى التعريف بالمجالات والموضوعات ومنهجيات القراءة في التراث اللغوي.
تركز المطبوعة على الأصول التراثية للسانيات التراثية عند العرب والغرب، وتستعرض أهداف القراءة في التراث. كما تقدم أنواع التقريب والقراءات الشمولية والقطاعية والنموذج الواحد.
وتوضح المطبوعة فروع لسانيات التراث، بما في ذلك:البحوث الصوتية، البحوث التركيبية،البحوث الدلالية، وتختتم بمحاولة لتقييم لسانيات التراث من منظور تحليلي، مع التركيز على منهجية الدراسة والمقاربات الحديثة.
Abstract
This publication provides a comprehensive introduction to Heritage Linguistics, starting from preliminary studies of languages among ancient nations, through the historical contributions of Arabs to linguistic studies, and moving to the definition of topics, subject matter, and reading methodologies in linguistic heritage.
The publication emphasizes the heritage foundations of linguistics in both Arab and Western traditions and outlines the objectives of reading heritage texts through titles, speeches, and introductions. It also presents types of approximation, holistic and sectional reading, and unified models.
The publication clarifies the branches of heritage linguistics, including: Phonetic research,Syntactic research,Semantic research. It concludes with an attempt to evaluate heritage linguistics from an analytical perspective, focusing on methodology and modern approaches.
