    ملخص: يعد الضرر شرطا ضروريا لتحقيق المسؤولية الادارية، وعلى أساسه ينشأ حق الضحية في اصلاح الضرر. وتتحقق مسؤولية الادارة إما على أساس الخطأ، أو بدون خطأ. ومن ناحية أخرى فإنَّ نوع الضرر قد يكون ماديا أو معنويا. وللاستفادة من إصلاح الضرر، يجب على المتضرر اللُّجوء إلى القاضي الإداري بواسطة دعوى التعويض. Résume : Le dommage est considéré comme une condition nécessaire de la responsabilité administratives, ce qui ouvre droit à la victime à une rèparation du dommage. La responsabilité de l’administration peut être fondée, soit sans faute, D’autre part le dommage peut être d'ordre matériel ou d'ordre moral. Mais pour pouvoir bénéficier du dommage, la victime doit saisir le jeuge administratif par un recours en indemnité.
