    الحماية القانونية للأحداث الجانحين في النظام القانوني الجزائري

    الملخص: لقد حرص المشرع الجزائري على توفير الحماية القانونية للحدث الجانح في جميع مراحل الدعوى العمومية، وهذا الموقف يتطابق مع ما أوصت به المواثيق و المعاهدات الدولية ومتماشيا مع ما توصلت إليه الأبحاث العلمية الحديثة، و لعل الأهم في ذلك هو أنه أدرج مجموعة من الأحكام و الآليات التي تكفل لهذه الفئة جميع الضمانات القانونية وكل الحقوق وتساهم في توفير الظروف المناسبة للعودة للحياة الاجتماعية الطبيعية وكذا العمل على تجنيبها العواقب الخطيرة المترتبة على الجريمة وآثارها السيئة، إن الهدف الأساسي من تبني هذه السياسة الوقائية هو الإصلاح وإعادة التأهيل حتى لا يكون هناك أي خطر قد يتهدد المجتمع بشكل عام. Résumé: Le législateur algérien a tenu à assurer une protection juridique du mineur délinquant à tous les stades de l'action publique, et cette position correspond à ce qui était recommandé par les conventions et traités internationaux et conforme aux conclusions de la recherche scientifique moderne, l'essentiel, il a adopté un ensemble de dispositions et de mécanismes qui permettent la protection de cette catégorie et procurent toutes les garanties juridiques et tous les droits, cette situation fournit les conditions appropriées pour le retour à une vie sociale normale, ainsi qu'à œuvrer pour éviter les conséquences dangereuses du crime et ses effets néfastes. L'objectif principal de l'adoption de cette politique préventive est la réforme et la réhabilitation afin qu'il n'y ait aucun danger qui puisse menacer la société en général. Abstract: The Algerian legislator wanted to ensure legal protection of the juvenile offender at all stages of public action, and this position corresponds to what was recommended by international conventions and treaties and in accordance with the conclusions of modern scientific research, Essentially, it has adopted a set of provisions and mechanisms that allow the protection of this category and provide all the legal guarantees and all the rights, this situation provides the appropriate conditions for the return to normal social life, as well as to work to avoid the dangerous consequences of crime and its harmful effects. The main objective of adopting this preventive policy is reform and rehabilitation so that there is no danger that can threaten society in general.
