    ملخص: يعتبر التحفظ إجراء من الإجراءات التي تقوم بها الدول ،في الاتفاقيات الدولية والمعاهدات الدولية، حيث التحفظات تتم وفقا لشوط قانونية معينة جاءت في اتفاقيتي فيينا لقانون المعاهدات لسنة 1969م و1986م ،وللتحفظ شروط شكلية وشروط موضوعية،ويكون التحفظ علي نص او بعض نصوص المعاهدة،مما يجعل الدولة غير ملزمة بالأثر القانوني لهذا النص المتحفظ عنه من طرفها. Résumé: La réserve est une procédure d'États, dans les conventions internationales et les traités internationaux, où les réserves sont formulées conformément à certaines dispositions juridiques des Conventions de Vienne de 1969 et 1986, L’Etat n’est pas lié par les effets juridiques de cette disposition. Abstract: The reservation is a procedure of States, in international conventions and international treaties, where reservations are made in accordance with certain legal provisions of the 1969 and 1986 Vienna Conventions, The State is not bound by the legal effect of this provision on its part.
