الملخص تعترض الأحكام القضائية الإدارية في أغلب الأحيان تعنت الإدارة في تنفيذها تحت ذريعة غياب نصوص قانونية تلزمها أو تأمرها بالتنفيذ ، أو بحجة حماية النظام العام، ما يجعل الحكم الحائز لقوة الشيء المقضي به معلقا دون تنفيذ. مما تطلب الأمر ايجاد حلول لهذه الإشكالات، من خلال منح القاضي الإداري سلطة تنفيذ الأحكام بإلزام الإدارة بتنفيذ الأحكام القضائية تحت طائلة غرامة تهديدية التي تمس بالذمة المالية للإدارة، أو قيام المسؤولية الإدارية نتيجة عدم التنفيذ.
