    الملخص : إن المسؤولية المدنية للمهندس المعماري تقوم على أساس الإزدواجية في التشريع الجزائري ،فإلى جانب خضوع المهندس المعماري للمسؤولية وفقا للقواعد العامة ،نجده إضافة لذلك يخضع لقواعد مسؤولية خاصة وضعت خصيصا للمشيدين بقواعد خاصة وشروط خاصة على خلاف القواعد العامة ،إذ خصها المشرع بأحكام بغية التشديد من مسؤولية المهندس المعماري ومقاول البناء ،فهي مسؤولية مفترضة بقوة القانون وتضامنية بين المتدخلين في مجال البناء ومتعلقة بالنظام العام،وبما أن المسؤولية العشرية تقررت على سبيل الإستثناء عن القواعد العامة ،فنجد المشرع الجزائري قد حدد نطاق تطبيقها بدقة سواء من حيث الأشخاص أو من حيث الموضوع وجعل من التسلم النهائي بداية لها. Summary : The civil liability of the architect is based on duality in Algerian legislation, besides submission of the architect for responsibility according to the general rules, in addition we find him subjected to special rules of responsibility that were developed specifically for constructors with special rules and special conditions in contrast to the general rules, as the legislator specified the special rules with provisions in order to tighten the responsibility of the architect and building contractor, it is a responsibility assumed by force of law and solidarity between those involved in the field of construction and related to public order, Since the special responsibility wase stablished as an exception to the generalrules, wefindthat the Algerian legislator has precisely defined the scope of its application both in terms of persons and in terms of subject matter and has made the final receipt its beginning. Résume : La responsabilité civile de l’architecte est fondée sur deux principes elle est régie dune part par les règles générales de la responsabilité spécifique les caractéristiques de responsabilité spécifique font delle d’une responsabilité contractuelle accompagne d’un accroissement et d’un durcissement de c’est règles compte tenu de la nature des obligations qui incombent a l’architecte et l’entrepreneur en construction ,il s’agit dune responsabilité assume par la force de la loi et par solidarité entre les acteurs ,le domaine de la construction est lie a l’ordre public ,et puisque la responsabilité décennale a été décidée comme une exception aux règle générale on constate que le législateur algérien a précisément défini le champ de son application ,que se soit en termes de personnes ou en terme de sujet
