    الملخـــص : نتكلم من خلال هذه المذكرة، عن الشروط الاستثنائية كمعيار مميز للعقود الإدارية، حيث نبين الشروط الاستثنائية المقررة للإدارة العامة في مواجهة المتعاقد معها، وكذا الشروط الاستثنائية المتعلقة بالامتيازات الممنوحة للمتعاقد مع الإدارة في مواجهة الغير، بالإضافة إلى شرطين استثنائيين، الإحالة إلى دفتر الشروط ، وجعل الاختصاص للقضاء الاداري .
