    حدود الحق في حرية التعبير في القانون الدولي لحقوق الانسان

    الملخص: حرية التعبير تعتبر من بين أهم حقون الانسان التي يحتاجها لممارسة حياته بصفة طبيعية، ، إلا أن ممارسة الحق في حرية التعبير تحتاج إلى قيود وضوابط تكفل التوازن بينه وبين بقية الحقوق الأخرى، وعليه فانه لابد أن لا يتم النظر لمبدأ تقييد الحق في حرية التعبير على انه حاجز وعائق مع الوضع في الاعتبار عدم جواز مساس هذه القيود والضوابط بأصل الحق. إلا أن الواقع يدل على أن هذه القيود والضوابط قد جاءت بأسلوب واسع مما ترك المجال للدول في تطبيقها بشكل يتطابق مع رغباتها ومصالحها وهو ما يتعارض مع الغرض من هذه القيود والضوابط. Résumé : La liberté d'expression est l'un des droits de l'homme les plus importants dont une personne a besoin pour pratiquer sa vie de manière normale. Cependant, l'exercice du droit à la liberté d'expression nécessite des restrictions et des contrôles qui assurent un équilibre entre celui-ci et le reste des autres droits et, par conséquent, le principe de restriction du droit à la liberté d'expression ne doit pas être considéré comme étant Une barrière et un obstacle, sachant que ces restrictions et contrôles peuvent ne pas affecter l'origine du droit. Cependant, la réalité indique que ces restrictions et contrôles sont venus de manière générale, laissant aux États la possibilité de les appliquer d'une manière conforme à leurs désirs et intérêts, ce qui est incompatible avec l'objectif de ces restrictions et contrôles. Summary : Freedom of expression is among the most important human rights that a person needs to practice his life in a normal manner. However, the exercise of the right to freedom of expression needs restrictions and controls that ensure a balance between it and the rest of the other rights, and therefore the principle of restricting the right to freedom of expression must not be considered A barrier and an obstacle, bearing in mind that these restrictions and controls may not affect the origin of the right. However, the reality indicates that these restrictions and controls came in a broad manner, leaving the space for states to implement them in a manner consistent with their desires and interests, which is inconsistent with the purpose of these restrictions and controls
