ازدواجية القرار الإداري بين الحرية التقديرية والتنفيذ القانوني

ملخص: يُعدّ القرار الإداري الأداة القانونية الأساسية التي تمارس من خلالها الإدارة صلاحياتها في تحقيق المصلحة العامة، غير أنه لا يصدر دائمًا في إطار سلطة موحّدة، بل تحكمه ازدواجية تتمثل في خضوعه تارةً لسلطة مقيدة تُلزم الإدارة باتخاذ تصرف محدد متى توافرت شروطه القانونية، وتارةً أخرى لسلطة تقديرية تُخوّلها هامشًا من الحرية في الاختيار بين التصرف أو عدم التصرف او كيفية التصرف ، وتمتد هذه الازدواجية إلى عناصر القرار الإداري بدرجات متفاوتة، وهو ما ينعكس على نطاق الرقابة القضائية التي تتدرج بحسب طبيعة السلطة الممارسة. ويُعدّ تحقيق التوازن بين هاتين السلطتين أساسًا لضمان فعالية الإدارة واحترام القانون. Abstract: The administrative decision is the fundamental legal tool through which the administration exercises its powers to achieve the public interest. However, it is not always issued within a unified framework; rather, it is governed by a duality. At times, it is subject to a bound power that obligates the administration to take a specific action whenever its legal conditions are met. At other times, it is subject to a discretionary power that grants it a margin of freedom to choose whether to act, refrain from acting, or determine how to act. This duality extends to the elements of the administrative decision in varying degrees, which in turn reflects on the scope of judicial review that scales according to the nature of the exercised power. Striking a balance between these two powers is essential to ensure administrative efficiency and respect for the rule of law. Résumé : La décision administrative constitue l'outil juridique fondamental par lequel l'administration exerce ses prérogatives pour réaliser l'intérêt général. Néanmoins, elle ne relève pas toujours d'une autorité uniforme, mais elle est régie par un dualisme : elle est tantôt soumise à une compétence liée qui oblige l'administration à adopter un comportement précis dès lors que ses conditions légales sont réunies, et tantôt à un pouvoir discrétionnaire qui lui confère une marge de liberté pour choisir d'agir, de s'abstenir ou de déterminer les modalités de son action. Ce dualisme s'étend, à des degrés divers, aux éléments de la décision administrative, ce qui se répercute sur l'étendue du contrôle juridictionnel qui varie selon la nature du pouvoir exercé. Établir un équilibre entre ces deux pouvoirs est essentiel pour garantir l'efficacité de l'administration et le respect de la légalité.

الملخص بعد اتفاق الدولتين على إقامة علاقات دبلوماسية بينهما، تتجه كل منهما إلى فتح البعثة الدبلوماسية لدى الدولة الأخرى، وتتولى البعثة الدبلوماسية المؤلفة من رئيسها وبقية أعضائها العديد من المهام الدبلوماسية، والتي يقع على عاتقها التزام التقيد بواجبات محددة أثناء تأديتهم للمهام المنوطة بها.. Resumé: Aprés que les deux pays on convenu d’établir des relations diplomatique entre eux , chacun d’eux tend à ouvrir la mission diplomatique dans l’aitre pays , la mission diplomatique composée de son président et du reste de ses membres entreprend de nombreauses missions diplomatique , ceux qui ont l’obligation d’adhérer à des taches spécifique dans l’execution des taches qui leur sont confiées .
