أدركت الجزائر أهمية تطوير الابتكار العلمي و تدعيمه للتنمية المستدامة، ببناء نظام قانوني قائم على استحداث جهاز خاص بحماية الملكية الصناعية سمي بالمعهد الوطني للملكية الصناعية، و بتكريس نصوص قانونية ( تشريعية و تنظيمية ) تحدد ضوابط قانونية لحماية الاختراع على المستوى الوطني، و وضع آليات وطنية لحماية براءة الاختراع التي لا يتعدى نطاقها حيز الإقليم الجزائري، مما جعلها تفكر في الانضمام الى اتفاقيات دولية رغبة منها في توسيع نطاق الحماية القانونية لبراءة الاختراع، لمسايرة الدول المتقدمة في الرقي و الازدهار . Summary Algeria has realized the importance of developing scientific innovation and supporting it for sustainable development, by building a legal system based on the creation of a special body for the protection of industrial property called the National Institute of Industrial Property, and by establishing legal texts (legislative and regulatory) that define legal controls for the protection of inventions at the national level, and by establishing national mechanisms for the protection of patents whose scope does not exceed the Algerian territory. This has prompted Algeria to consider joining international agreements, in its desire to expand the scope of legal protection for patents, to keep pace with developed countries in terms of advancement and prosperity.

ملخص: تعد الجريمة المنظمة العابرة للحدود واحدة من أخطر الظواهر الإجرامية الحديثة، تشكل تحديا بارزا للدول والمجتمع الدولي ككل بفعل ما تنطوي عليه من تهديد صارخ للأمن والإستقرار على المستويين الدولي والوطني، ناتج عن خصوصية هذه الجريمة وتميزها عن باقي النظم الإجرامية الأخرى، خاصة من حيث إمكانية تدويل الأنشطة الإجرامية المرتكبة في سياقها عبر الدول والقارات. وتحسبا لعواقب هذه الظاهرة الإجرامية كان لزاما على الدول أن توجه عنايتها بها، وذلك من خلال البحث عن سياسة جزائية كفيلة بتحقيق الفعالية المرجوة منها في مجال الوقاية من هذه الجريمة ومكافحتها، سواء في الجانب الموضوعي منها، أو الجانب الإجرائي بإعداد خطط وإستراتجيات أمنية وقضائية ذات بعد دولي ووطني. Résumé : La criminalité organisée transnationale, est considéré comme l'une des phénomènes récents les plus dangereux. Elle constitue un défit réel aux états et a la société internationale à cause du grave menace à la sécurité, la stabilité au niveau international et national, due la spécificité de cette crime par rapport aux autres systèmes criminologiques, surtout en termes de la possibilité d'internationaliser commis dans le cadre d'activités criminelles à travers les pays et les continents. Pour face aux conséquences de ce phénomène, les états étaient contraints de chercher Une politique criminelle efficace pour se prémunir et lutter cette crime, tant sur le volet Objectif, ainsi que sur le volet procédural, par l’élaboration de plan et stratégies sécuritaires et judiciaires d'une dimension internationale et nationale. summary: Transnational organized crime, is considered one of the more recent phenomena the dangereux.Elle is a real challenge to states and international society because of the serious threat to the security, stability at the international and national level, due specificity this crime compared to other systems criminological, especially in terms of the ability to internationalize committed as part of criminal activities across countries and continents To face the consequences of this phenomenon, the states were forced to seek an effective criminal policy to guard and fight this crime, both on the lens cover, as well as the procedural part, by the level of development and security and judicial strategies for international and national.

الملخص: تعد الحماية الإدارية للمستهلك إحدى الآليات الأساسية التي تعتمدها الدولة لضمان التوازن في العلاقة بين المتعاملين الاقتصاديين والمستهلك، من خلال تدخل الهيئات الإدارية المختصة لضبط السوق والوقاية من المخاطر التي تهدد الصحة والسلامة العامة وترتكز هذه الحماية على جملة من التدابير الرقابية، كما تمكن الإدارات المعنية لاسيما مصالح وزارة التجارة والجمارك ومجلس المنافسة والجماعات المحلية من صلاحيات واسعة للتفتيش واتخاذ إجراءات تحفظية مع اعتماد آليات للتحسيس والتبليغ، وتهدف هذه الحماية إلى تحقيق بيئة استهلاكية آمنة وتكريس مبدأ الوقاية كأولوية في السياسة الاستهلاكية. Résumé : La protection administrative des consommateurs est l’un des mécanismes fondamentaux adoptés par l’État pour assurer une relation équilibrée entre les opérateurs économiques et les consommateurs. Cela se fait grâce à l’intervention d’organismes administratifs compétents pour réguler le marché et prévenir les risques qui menacent la santé et la sécurité publiques. Cette protection repose sur un ensemble de mesures de contrôle. Elle confère également aux administrations compétentes, notamment au Ministère du Commerce, aux Douanes, au Conseil de la concurrence et aux collectivités locales, de larges pouvoirs d’inspection et de prise de mesures conservatoires, tout en adoptant des mécanismes de sensibilisation et de signalement. Cette protection vise à créer un environnement de consommation sûr et à établir le principe de prévention comme priorité dans la politique de consommation. Abstract : Administrative consumer protection is one of the fundamental mechanisms adopted by the state to ensure a balanced relationship between economic operators and consumers. This is achieved through the intervention of competent administrative bodies to regulate the market and prevent risks that threaten public health and safety. This protection is based on a set of control measures. It also empowers relevant departments, particularly the Ministry of Commerce, Customs, the Competition Council, and local authorities, with broad powers to inspect and take precautionary measures, while adopting awareness-raising and reporting mechanisms. This protection aims to achieve a safe consumer environment and establish the principle of prevention as a priority in consumer policy.

الملخص: تستمد المسؤولية المدنية للمسير في شركة المساهمة قوامها من القواعد العامة أي من القانون المدني باعتباره الشريعة العامة، ومن ثم فقد تكون إما مسؤولية عقدية أو مسؤولية تقصيرية كما قد تكون شخصية أو تضامني . ومن ثم فإنه يحق لكل شخص طاله ضرر ناجم عن تصرفات المسير أن يلجأ للقضاء للمطالبة بالتعويض وذلك وفقا لأحكام المواد 715 مكرر 21 إلى 715 مكرر 29 من القانون التجاري الجزائري . Résumé : La responsabilité civile du dirigeant dans la société par actions trouve son fondement dans les règles générales, c'est-à-dire du droit commun ,et il peut donc s'agir soit d'une responsabilité délictuelle car elle peut être personnelle ou conjointe. Ainsi, toute personne lésés du fait des agissements du gérant à le droit de saisir la justice pour demander réparation conformément au dispositions des articles 715 bis 21 à 715 bis 29 du code de commerce Algérien. Abstract: The civil responsability of the menager in the joint-stock company derives its foundation from de general rules ,Hence,it my be either a retirement liability or a tort liability,It my also be personal or solidarity hence, evry person who has suffered damage resulting from the actions of the manager has the right to resort to the judiciary to demand componsation,in accordance with the provisions of articles 715 bis21 _715bis 29 of the Algerian commercial code.
