الملخص: لقد شكل التلقيح الاصطناعي، سببا قويا لظهور ضوابط وأطر شرعية و أخلاقية تحكمه، ففقهاء الشريعة الإسلامية منعوا وحرموا عمليات التلقيح التي تتم خارج إطار العلاقة الزوجية، في حين أن القانون الجزائري نص عليها في مادة واحدة مما يعد قصورا في معالجة هذه الظاهرة الجديدة، بحيث لم ينص المشرع الجزائري على مسألة الضرورة التي تشكل الضابط الرئيسي للجوء إلى التلقيح الاصطناعي، كما لم ينص على عقوبات رادعة و سالبة للحرية لمن يتلاعب بهذه التقنية من أجل خلط الأنساب أو خلط اللقائح أو لمن يقوم بالتلقيح الاصطناعي خارج إطار العلاقة الزوجية وذلك حماية للأسرة الجزائرية المسلمة. Résumé: L’insémination artificielle a fortement causé la naissance de plusieurs règles de morale et de contrôles dans le cadre de sa légitimité. Les jurisprudents islamiques ont interdit et nié les opérations de pollinisation se déroulant hors du cadre des relations conjugales, alors que la loi algérienne n’a rédigée qu’un seul article, ce qui a constitué un traitement insuffisant a se nouveau Phénomène, Le législateur algérien a stipulé la nécessité, qui est le principal critère de l'utilisation de l'insémination artificielle, sans prévoir de sanctions dissuasives et de prison pour ce qui manipule cette technique pour mélanger des généalogies ou mélanger les vaccins ou qui effectue l'opérations de pollinisation en dehors de la relation conjugale Afin de protéger la famille algérienne musulmane. Abstract: Artificial insemination has caused the birth of several rules of morality and controls as part of its legitimacy. Islamic jurisprudence has prohibited and denied pollination operations taking place outside of conjugal relations, while the Algerian law has drafted only one article, which has been an insufficient treatment at a new phenomenon, the Algerian legislator has stipulated the necessity, which is the main criterion for the use of artificial insemination, without providing dissuasive sanctions and imprisonment for who manipulates this technique to mix genealogies or mix vaccines or that carries out the pollination operations outside the conjugal relationship To protect the Algerian Muslim family.
الرقابة على تنفيذ الميزانية المحلية في الجزائر

الملخص: إن الغاية من الرقابة المالية على الجماعات المحلية وهي حفاظ على المال العام واستغلال الأمثل للموارد المالية كذلك محاربة الفساد بمختلف انواعه، وتحقيق الأهداف المسطرة مسبقا في مخطط عملي للولاية والبلدية، وذلك بتنفيذ برنامج واقعي من أجل الوصول إلى التنمية المحلية، الا ان هذه الاجهزة واجهت عدت صعوبات عند اداء مهامها خاصة التغيرات المستمرة والمفاجأة التي تشهدها مختلف القطاعات، لذلك يتوجب على النخب المعنية اعادة النظر من أجل ايجاد اليات جديد لمواكبة هذه التغيرات ومعالجة التحديات من أجل وصول إلى تطبيق رقابة الأداء التي تركز على انعاش الاقتصاد، وتحقيق التنمية بل السعي للوصول إلى التنمية الشاملة. Résumé: Le contrôle financier exercé sur les communautés locales a pour objectif de préserver les deniers publics, d'optimiser l'utilisation des ressources financières et de lutter contre la corruption sous diverses formes. Il permet également d'atteindre les objectifs préalablement définis dans un plan concret pour l'État et les municipalités, en mettant en œuvre un programme réaliste d'accès au développement local, Les difficultés d’exécution de ses fonctions, en particulier les changements continus et les surprises vécues par divers secteurs, ont incité les élites concernées à reconsidérer leurs réflexions afin de trouver de nouveaux mécanismes pour suivre le rythme de ces changements et relever les défis afin de parvenir à l’application d’un contrôle de la performance centré sur la reprise de l’économie, et Développement réel, mais la poursuite du développement complet. Summary: The financial control exercised over local communitiesisaimed at preserving public funds, optimizing the use of financialresources and combating corruption in variousforms. It alsoallows to reach the objectives previouslydefined in a concrete plan for the State and the municipalities, by implementing a realistic program of access to the local development, The difficulties of execution of itsfunctions, in particular the continuous changes and the surprises experienced by varioussectors, prompted the elitesconcerned to reconsidertheirreflections in order to find new mechanisms to keep pace withthese changes and meet the challenges in order to achieve the application of a performance control centered on the recovery of the economy, and Real Development, but the pursuit of full development.
الصلاحيات الواسعة للسلطة التنفيذي في إطار مشروعية إستثنائية

ملخص: منح الدستور الجزائري لرئيس الجمهورية صلاحيات واسعة في ظل الظروف الإستثنائية من بينها صلاحية إعلان حالات الظروف الإستثنائية وصلاحية التشريع بأوامر وصلاحية وقف العمل بالدستور ... إلخ وكلها صلاحيات تتعلق بالضبط الإداري مع غياب فعلي للرقابة على هاته الصلاحيات ومنحها طابع شكلي فقط. Résumé : Le constitutionnel algérien a offert plusieurs priviléges au président dans des conditions exceptionnelles parmi elles, les déclarations de ces cas exceptionnels et le pouvoir de législation par ordonnances et de suspendre la constitution … est. Summary : The Algerian Constituonal party has offered several privileges to the president in exceptional circumstances among them, the declarations of these exceptional cases and the power of legislation by ordinances and to suspend the constitution … is. All these powers are related to the administrative pramerter and the absence of control and giving it a formal charcter .

الملخص: إن طبيعة عمل الشرطة يمتاز بصعوبات عديدة راجعة لمحيط العمل وطبيعة الآليات والإجراءات التي يتم الاعتماد عليها في هذا العمل الذي يعرض على أعوان الشرطة كالتدخل والاحتكاكات بالأفراد الأمر الذي يجعلها ترتكب أخطاء من شأنها أن تؤدي إلى قيام المسؤولية الادارية وقد ينتج ضرر للغير مما يستلزم تعويضه Résume : La nature de travail de la police rencontre de nombreuse difficultés en raison de l’environnement de travail de la nature des mécanismes et procédures reposant le travail, qui force l’enter ventions de poluce et des friction avec des individués ce qui cause dommages qui doivent un compensation . Abstract : The nature of the work of the police is chaaracterized by many difficulties due to the work environment and the nature of the mechanisms and procedures that are relied on in this work, which is presented to police agents such as iterferences and friction with individuals, which makes them commit mistakes that lead to administrative liability and may result in damage to others and neccessites compensation.
