    الملخص: تعد الصفقات العمومية من أهم الوسائل التي تعتمد عليها الدولة كأداة للتنمية والتطوير الاقتصادي، لذلك عمد المشرع-ج في إطار الإصلاح القانوني للصفقات العمومية بتكريس مبادئ الحوكمة في كل المراحل التي تحكم الصفقات العمومية سواء إرساء الشفافية في الإجراءات وتعزيز المساواة لأجل الوصول إلى الطلب العمومي، إضافة إلى فرض آليات الرقابة سواء (داخلية أو خارجية قبلية أو رقابة وصاية) لمحاربة ظاهرة الفساد واحترافية الإجرام وتفعيل مبدأ المسؤولية وترشيد تسيير الأموال العمومية. Résumé : Les marchés publics sont l’un des moyens les plus importants sur les quels l’Etat s’appuie comme outil de développement économique et de développement. Ainsi ,le législateur algérien adopté ,dans le cadre de la réforme juridique des marchés publics ,les principes de gouvernances ,à toutes les étapes qui régissent marchés publics ,que ce soit en établissant la transparence dans les procédures et en promouvant l’égalité afin d’atteindre la demande publique , en plus d’imposer des mécanismes de contrôle, qu’ils soient internes ou externes tribaux ou de tutelle, pour lutter contre le phénomène de la corruption et la professionnalisation du crime, en activant le principe de responsabilité et rationaliser la gestion des denier publics. Summary : Public procurement is one of the most important means that the state relies on as a tool for economic development .Therfore, the Algerian legislator adopted, within the framework of the legal reform of public deals, the principles of governance in all stages that govern public deals, whether by establishing transparency in procedures and promoting equality in ordre to reach public demand, in addition to lmposing oversight mechanisms, whether internal or external, tribal or guardianship, to combat the phenomenon of corruption and the professionalization of crime, activating the principle of responsibility and rationalizing the management of public funds .
