الملخص: تناولت هذه الدراسة موضوع حماية المدنيين أثناء النزاعات المسلحة في إطار القانون الدولي الإنساني، باعتباره من أهم المجالات التي تعكس البعد الإنساني للقانون الدولي. هدفت الدراسة إلى تحديد مفهوم المدنيين وبيان المعايير المعتمدة لتمييزهم عن المقاتلين، مع إبراز المبادئ الأساسية التي تحكم حمايتهم أثناء النزاعات المسلحة، وعلى رأسها مبدأ التمييز ومبدأ التناسب ومبدأ الضرورة العسكرية. كما تم التطرق إلى نطاق الحماية القانونية، سواء الحماية العامة التي تشمل جميع المدنيين، أو الحماية الخاصة المقررة لفئات معينة كالأطفال والنساء والطواقم الطبية والإغاثية. واعتمدت الدراسة على المنهج الوصفي والتحليلي، مع الاستعانة بالمقارنة بين الفقه الإسلامي والقانون الدولي الإنساني. وتوصلت إلى أن الإطار القانوني الدولي يوفر حماية معتبرة للمدنيين، غير أن التطبيق العملي يشهد عدة تحديات، أبرزها ضعف آليات التنفيذ وتزايد النزاعات غير الدولية والتطور التكنولوجي في وسائل الحرب. كما خلصت الدراسة إلى ضرورة تعزيز آليات الرقابة والمساءلة وتطوير القواعد القانونية بما يواكب التحولات الراهنة. وفي الأخير، أكدت الدراسة أن حماية المدنيين تبقى مسؤولية جماعية تتطلب التزاماً دولياً فعلياً لتجسيدها على أرض الواقع. Abstract This study addresses the protection of civilians during armed conflicts within the framework of International Humanitarian Law, as one of the most significant areas reflecting the humanitarian dimension of international law. It aims to define the concept of civilians and clarify the criteria used to distinguish them from combatants, while highlighting the fundamental principles governing their protection, notably the principles of distinction, proportionality, and military necessity. The study also examines the scope of legal protection, including both general protection for all civilians and special protection for vulnerable groups such as women, children, and medical and humanitarian personnel. It adopts descriptive and analytical approaches, with a comparative perspective between Islamic jurisprudence and International Humanitarian Law. The study concludes that, despite the existence of a comprehensive legal framework, practical implementation faces major challenges, including weak enforcement mechanisms, the rise of non-international conflicts, and technological developments in warfare. It further emphasizes the need to strengthen monitoring and accountability mechanisms and to adapt legal rules to contemporary changes. Ultimately, the protection of civilians remains a collective responsibility requiring genuine international commitment.
