    الملخص: من الصعوبة تعريف الخطأ الجسيم طالما أن القاضي هو من يقوم بتقديره و الكشف عن ملابساته، و قد اشترط القضاء الإداري الخطأ الجسيم لترتيب المسؤولية الإدارية على أساس الخطأ المرفقي. فهناك مرافق اشترط الخطأ الجسيم في بعض أنشطتها التي تتصف بالخطورة كما اشترط الخطأ الجسيم في كل أنشطة بعض المرافق نظرا لخصوصية نشاطها ويرجع ذلك إلى أحد الأسباب : - صعوبات خاصة في سير المرفق العام - دقة خاصة في أداء الوظيفة كممارسة الرقابة - تحديد تقنيات عالية في نشاط المرفق مثل النشاط الطبي Il est difficile de définir une erreur fatale tant que le juge est celui qui l'évalue et en dévoile les circonstances, et que le pouvoir judiciaire administratif a stipulé la grave erreur d'organiser la responsabilité administrative sur la base de l'erreur de l’établissements. Certaines établissements ont stipulé des erreurs graves dans certaines de leurs activités qui sont dangereuses et ont également stipulé des erreurs graves dans toutes les activités de certaines installations en raison de la confidentialité de leurs activités et cela est dû à l'une des raisons: - Difficultés particulières dans le fonctionnement de l'établissement public - Précision particulière dans l'exécution du travail, comme l'exercice du contrôle - Identifier les hautes technologies dans l'activité de l'établissement, comme l'activité médicale It is difficult to define a fatal error as long as the judge is the one who assesses it and discloses the circumstances, and the administrative judiciary has stipulated the serious error of organizing administrative responsibility on the basis of the error of the 'establishments. Some establishments have stipulated serious errors in some of their activities which are dangerous and also stipulated serious errors in all activities of certain facilities due to the confidentiality of their activities and this is due to one of the reasons: - Particular difficulties in the functioning of the public establishment - Particular precision in the execution of the work, such as the exercise of control - Identify high technologies in the activity of the establishment, such as medical activity.
