    زواج القاصر في قانون الأسرة الجزائري و الفقه الإسلامي

    الملخص* إنّ الزّواج كونه ذلك الرّباط الإلهي المقدّس لتكوين الأسر و بناء المجتمعات لا يقتصر فقط على الأزواج البالغين، بل يتعدّى ذلك إلى القُصّر، الأمر الّذي جعل فقهاء الشّريعة الإسلامية و فقهاء القانون يضبطون زواج القُصّر بأحكام و إجراءات خاصّة، تقتصر على وجود ضرورة مُلِحّة و مصلحة مشروعة للحصول على ترخيص قضائي يمكِّن الزّوج القاصر من عقد زواجه، مكتسباً في ذلك حقوقاً و مقيّداً بالتزامات، الأمر الّذي يجعله في مركز قانوني مثله مثل البالغ فيما يتعلّق بالزواج و آثاره. Résumé Le Mariage, lien sacré et divin pour construire la cellule familiale et de là, les sociétés, ne se limite pas seulement aux personnes majeures mais aussi aux mineurs, ce qui a amené les oulémas en Chariaa et les législateurs en droit à légiférer dans ce sens pour donner les mêmes droits et obligations à ces derniers à condition de l’existence d’une nécessité urgente et d’un intérêt légitime pour obtenir une licence judiciaire, afin de consommer le mariage au même titre que leurs aînés majeurs. Summary Marriage as a sacred divine bond to create famillies and build up societies is not limited only to major, but goes beyond that for minors too, which made Islamic and law jurists set specific provisions and procedures to controle this kind of marriage which is Minors Marriage. These provisions and procedures are related to the existence of an urgent necessity and a legitimate interest to obtain a judicial license that allows the minor to get married, have rights and take on obligations that allow him/her to obtain a legal status as an adult cocerning the consequences of marriage.
