    اﻟﻔﻬﺮس ﻳﻌﺘبر اﻟﻘﻀﺎء ﻣﻦ أﻫﻢ اﻟﻮﻇﺎﺋﻒ في المجتمع الحديث، ﻓﻬﻮ ﺳﻠﻄﺔ ﻣﺴﺘﻘﻠﺔ ﺗﻔﺼﻞ في اﻟﻨﺰاﻋﺎت ﺑين اﻟﻨﺎس وﻗﺪ ﺗﻄﻮرت الحياة في جميع المجالات ،وﻧﺘﺞ ﻋﻦ ذﻟﻚ تغير ﻋﻤﻴﻖ في اﻟﻌﻼﻗﺎت ﺑين اﻷﻓﺮاد والمؤسسات، ﺣﻴﺚ ﻇﻬﺮت ﺻﻴﻎ ﺟﺪﻳﺪة ﻣﻦ المعاملات أﺣﺪﺛﺖ تشعبا في اﻟﻮﺿﻌﻴﺎت اﻟﻘﺎﻧﻮﻧﻴﺔ.واﻟﻘﻀﺎء ﻛﻐيرﻩ ﻣﻦ المجالات ﻻ ﺑﺪ أن ﻳﻮاﻛﺐ اﻟﺘﻄﻮرات والمستجدات والمتغيرات اﻟتي ﻳﺸﻬﺪﻫﺎ اﻟﻌﺎلم وﻳﺘﻔﺎﻋﻞ ﻣﻌﻬﺎ بإيجابية،وفي ﻫﺬا اﻹﻃﺎر ﻳﺸﻬﺪ اﻟﻌﺎلم ﻣﻨﺬ ﺳﻨﻮات ﺛﻮرة ﺗﻜﻨﻮﻟﻮﺟﻴﺔ شملت ﻛﻞ الميادين أﺻﺒﺢ ﺑﻔﻀﻠﻬﺎ اﻟﻌﺎلم ﻗﺮﻳﺔ ﺻﻐيرة واﺧﺘﺰﻟﺖ المسافات ﻓﻴﻬﺎ واﻹﺟﺮاءات،ﺣﻴﺚ ﺳﺎرﻋﺖ اﻟﻌﺪﻳﺪ ﻣﻦ اﻟﺪول تحت ﻋﻨﻮان العولمة وﻋﺼﺮﻧﺔ اﻹدارة اﻟﻌﺎﻣﺔ، إلى اﺳﺘﻌﺎﻧﺔ ﺑﺎﻟﺸﺒﻜﺔ اﻟﻌﻨﻜﺒﻮﺗﻴﺔ ﻣﻦ أﺟﻞ اﻟﻨﻬﻮض ﺑﺎﻟﺘﺴﻴير اﻹداري وكذا ﻣﻦ أﺟﻞ ﺗﻘﺮﻳﺐ اﻹدارة ﻣﻦ المواطن وتمكينه ﻣﻦ اﻻﺗﺼﺎل بهﺎ في أي ﻣﻜﺎن وفي أي زﻣﺎن،وﻣﻦ ﺑين المجالات اﻟتي ﻋﺮﻓﺖ ﻗﻔﺰة ﻧﻮﻋﻴﺔ نحو اﻷﻣﺎم اﻟﻮﻇﻴﻔﺔ اﻟﻘﻀﺎﺋﻴﺔ اﻟتي تم اﺳﺘﺤﺪاﺛﻬﺎ ﺑﺮاﻣﺞ وﺗﻄﺒﻴﻘﺎت ﺗﻜﻨﻮﻟﻮﺟﻴﺔ ﺳﻬﻠﺔ وﺳﺮﻋﺔ ﻣﻦ ﻣﻬﻤﺔ اﻟﻘﻀﺎء. Résumé Le pouvoir judiciaire est l'une des fonctions les plus importantes de la société moderne. C'est une autorité indépendante qui sépare les conflits entre les personnes.
