Item الاليات القانونية لحماية حقوق البيئة(2017) أزمور, سميةملخّـص: يعالج موضوع"الآليات القانونية لحماية البيئة، الآليات الوقائية لحماية البيئة من جهة، باعتبارها هدف رئيسي تسعى السياسة البيئية إلى تحقيقه لتفادي وقوع كوارث بيئية وذلك من خلال التخطيط البيئي بنوعيه المحلي والمركزي، وكذا بوسائل الضبط الإداري البيئي والتحفيز الضريبي البيئي وكذا دور الإدارة على المستويين الوطني المركزي والمحلي وكذا دور الجمعيات. ومن جهة أخرى الآليات الردعية تمثلت في الجزاء الإداري ويكون في شكل عقوبة مالية وغير مالية، هذا فضلا عن إقرار الجزاء المدني الذي يلتزم بمقتضاه من ألحق ضررا بالبيئة بالتعويض عن الضرر البيئي ويكون في شكل تعويض عيني أو نقدي يقره القاضي بالإضافة إلى الجانب الجنائي بنظام ردعي صارم ضد الاعتداءات البيئية. Résumé: Aborde le sujet des « mécanismes juridiques pour la protection de l'environnement, des mécanismes de prévention pour la protection de l'environnement d'une part, comme un objectif clé de la politique environnementale cherche à atteindre afin d'éviter l'apparition de catastrophes environnementales dans la planification environnementale des deux types locaux et centraux, ainsi que par des moyens de contrôle administratif de la fiscalité environnementale et la stimulation de l'environnement, ainsi que le rôle de la gestion au niveau national central et local, ainsi que le rôle des associations. ce ainsi que l'adoption de la peine civile, qui est engagée en vertu de laquelle a infligé des dommages à la compensation de l'environnement pour les dommages environnementaux et être sous la forme d'une compensation en nature ou en espèces approuvé par le juge en plus du côté criminel, un système de dissuasion strict sur les autres mécanismes de dissuasion à la main était la sanction administrative est sous forme de sanctions financières et non financières, contre les agressions de l'environnement.
