ملخص:
يقوم النظام القانوني لصفقة إنجاز الأشغال العامّة على ضوء المرسوم الرئاسي 15-247، على أسس و قواعد في أطار هيكلي رقابي متشدّد و صارم، حماية للمال العام، يخوّل فيه المصلحة المتعاقدة من امتيازات إستثنائية لإختيار المتعامل المتعاقد الأمثل للتعاقد معه، بهدف تحقيق المصلحة العامّة، مقابل تقديم ضمانات لتنفيذ و إنجاز المشاريع التنموية.
Résumé:
Le système juridique pour la passation des marchés de travaux publics est basé sur le décret présidentiel 15-247, sur des fondations et des règles dans un cadre réglementaire strict, pour la protection des fonds publics, dans lequel l'intérêt contractant est habilité avec des privilèges exceptionnels afin de choisir le concessionnaire contractuel idéal avec lequel passer un contrat, dans le but de réaliser l'intérêt public, En échange de la fourniture de garanties pour la mise en œuvre et l'achèvement des projets de développement
Abstract :
The legal system for the procurement of public works is based on Presidential Decree 15-247, on foundations and rules within a strict regulatory framework, for the protection of public funds, in which the contracting interest is empowered with exceptional privileges in order to choose the ideal contractual concessionaire with which to contract, with the aim of achieving the public interest, In exchange for the provision of guarantees for the implementation and completion of development projects.
