Item الاستقرار التشريعي كضمانة لاستقطاب الاستثمارات الأجنبية(University Centre of Maghnia, 0020-12-02) بن ميلود عبد الرحيم; تحت إشراف أ. عطار نسيمةالملخص: يعتبر الاستثمار الأجنبي حجر الزاوية و أساس اقتصاديات دول العالم، خاصة الدول النامية أو السارية في طريق النمو، و يعتبر شريان رئيسي يتدفق من خلاله رأس المال و الخبرة الفنية و العلمية و التكنولوجية. فأصبح النظام الاقتصادي لأي دولة يقاس بمدى قدرته على جذب الاستثمار الأجنبي فكل دولة اصبحت تبذل كل الجهود لتوليد بيئة استثمارية ملائمة تستقطب المستثمرين الأجانب، و ذلك من خلال تقديم مزايا و حوافز و ضمانات مغرية سواء قانونية أو مالية أو ضريبية إلا انه رغم الجهود المبذولة هناك بعض المعوقات و الحواجز التي تنقص من الاستثمارات الأجنبية و من أهم الضمانات التشريعية الاستثنائية لاستقطاب الاستثمار الأجنبي نجد شرط الاستقرار أو الثبات التشريعي و الذي يرد في عقد الاستثمار، و قد ساهم في الحد من ممارسة الدولة لسلطاتها التشريعية من خلال غل يد الدولة في تعديل العقد و المساس به بإرادتها المنفردة. إلا أنه تثور العديد من المنازعات المتعلقة بالاستثمار الأجنبي بين الدول المضيفة للاستثمار و المستثمر الأجنبي، و لتسوية هذه المنازعات يتم اللجوء إلى المركز الدولي لتسوية منازعات الاستثمار (CIRDI) و الذي يعتبر أهم الوسائل و أنجعها في هذا و الذي سيبقى آلية ضرورية و فعالة للموازنة بين مصالح الدول المضيفة للاستثمار و المستثمر الأجنبي. Résumé : L’investissement étranger est la base de l’économie des pays du monde surtout des pays en développement, et travers lui du flux de capitaux et d’expertise scientifique et technologique l’économie de tout pays se mesure à sa capacité d’attirer les investissements étrangères. Chaque pays déploie des efforts pour attirer les investisseur étrangères et des garanties juridiques, financière et fiscales, mais il existe certains obstacles et barrière qui manquent d'investissement étranger et l’une des garantie juridiques les plus importantes et l’exigence de stabilité l’législative contenue dans le contrat et le violer de sa propre volent. Des différents liés à l’investissement étranger peuvent surgir entre le pays hôte de l’investissement et l’investisseur étranger, et pour régler ses différends, recouvrir au centre international pour le règlement des différends relatifs aux investissement qui est le moyen le plus important et le plus efficace de régler le différends relatif aux investissement étranger Abstract : Forgien investissement is the basis of the economies of the world countries especially the developing countries and through is the capital and scientific and technological expertise flow. The economy of any country is measured by its ability to attract foreign investment. Every country exerts efforts to attract foreign investors by offering legal, financial, and tax benefits and guarantees, but there are some obstacles and barriers that lack foreign investment and one of the most important legal guarantees is the legislative stability requirment that is contained in the investment contract wich limits and restricts related to foreign investment may arise between the host country of the investment and the foreign investor and to settle these disputes, wich is the most important and successful means of settling investment disputes.
