Item الإطار القانوني لبراءة الإختراع في التشريع الجزائري(University Centre of Maghnia,, 2025-07-07) ريفي أمينة; تحت إشراف الأستاذة مجدوب نوالأدركت الجزائر أهمية تطوير الابتكار العلمي و تدعيمه للتنمية المستدامة، ببناء نظام قانوني قائم على استحداث جهاز خاص بحماية الملكية الصناعية سمي بالمعهد الوطني للملكية الصناعية، و بتكريس نصوص قانونية ( تشريعية و تنظيمية ) تحدد ضوابط قانونية لحماية الاختراع على المستوى الوطني، و وضع آليات وطنية لحماية براءة الاختراع التي لا يتعدى نطاقها حيز الإقليم الجزائري، مما جعلها تفكر في الانضمام الى اتفاقيات دولية رغبة منها في توسيع نطاق الحماية القانونية لبراءة الاختراع، لمسايرة الدول المتقدمة في الرقي و الازدهار . Summary Algeria has realized the importance of developing scientific innovation and supporting it for sustainable development, by building a legal system based on the creation of a special body for the protection of industrial property called the National Institute of Industrial Property, and by establishing legal texts (legislative and regulatory) that define legal controls for the protection of inventions at the national level, and by establishing national mechanisms for the protection of patents whose scope does not exceed the Algerian territory. This has prompted Algeria to consider joining international agreements, in its desire to expand the scope of legal protection for patents, to keep pace with developed countries in terms of advancement and prosperity.Item الحماية الجزائية للملكية الوقفية في التشريع الجزائري(University Centre of Maghnia, 2025-07-02) مزيان عبير; تحت إشراف الأستاذة بن عودة صليحةThe waqf property is of great importance in ensuring that waqf occupies a high place in society and religion and protects it from any abuse or abuse of legislative power through a full range of criminal measures. This is consistent with article 36 of the Suspension of Action Act and some of the penalties referred to In Algeria’s Penal code as a general rule of criminalization. To preserve it, the legislature had to revise the waqfs. الملخص: إن الأملاك الوقفية حظيت بأهمية كبيرة، وهذا لاحتلال الوقف مكانة رفيعة في المجتمع والدين وللحفاظ عليها وحمايتها من أي تعرّض أو اعتداءات تطالها خصّها المشرّع بمجمل من التدابير الجزائية، وهذا طبقا لما نصّت عليه المادّة 36 من القانون المتعلق بالأوقاف وبعض العقوبات التي أحالها إلى قانون العقوبات باعتباره القاعدة العامّة للتجريم. وهذا من أجل الحفاظ عليه فكان على المشرّع أن يعيد النظر في قانون الأوقاف بسّن نصوص صارمة ورادعة على كلّ من تسوّل نفسه الاعتداء على الأوقاف لأنها من الموارد الهامّة للمساهمة في التنمية الاقتصادية والاجتماعية والثقافية في الجزائر.
