    الملخص : يرتب عقد النقل البحري للبضائع في ذمة الشاحن التزامات متعلقة بالبضاعة تتمثل في تهيئة البضاعة للنقل، وتسليمها للناقل في الزمان والمكان المتفق عليهما، إضافة الى التزامات مالية تتجلى في دفع الشاحن الأجرة للناقل . كذلك يعد الشاحن البحري مسؤولاً عن البضائع التي يسلمها للناقل حالة اخلاله بأحد التزاماته بتحقيق نتيجة او بذل عناية فإنه يمكن للمتضرر رفع دعوى على الشاحن للحصول على تعويض.     الملخص : إن الأساس من وراء حماية المستهلك في كافة العقود و العقد الإلكتروني خاصة، راجع إلى كونه الطرف الضعيف في العلاقة التعاقدية مقارنة بالمورد الإلكتروني، الذي يعد الطرف القوي إقتصاديا، حيث يفرض شروطه في العقد، مما قد يدفع بالمستهلك للتعاقد في عجالة و عن قلة دراية بمواصفات السلعة أو الخدمة محل التعاقد .
