Item النظام القانوني لمجلس المنافسة(University Centre of Maghnia, 2023-07-17) بوهنة خليدة; تحت إشراف الأستاذة تيانتي مريمالملخص: يعتبر قانون المنافسة اللبنة الأساسية في الانتقال من النظام الذي يرتكز على الاقتصاد الموجه إلى نظام اقتصاد السوق الحر ،و الذي يهدف إلى تحرير شروط ممارسة المنافسة في السوق ،وتفادي كل ممارسات مقيدة للمنافسة و مراقبة التجميعات الاقتصادية قصد زيادة الفعالية الاقتصادية وتحسين ظروف معيشة المستهلكين، وبموجب هدا القانون تم استحداث مجلس المنافسة كسلطة ادارية مستقلة تم منحها صلاحيات واسعة من أجل الحظر القانوني للممارسات التعسفية و معاقبة مرتكبيها Résumé : La loi sur la concurrence est considérée comme la pierre angulaire de la transition du système fondé sur l'économie dirigée vers le système de l'économie de marché libre, qui vise à libéraliser les conditions d'exercice de la concurrence sur le marché, en évitant toutes les pratiques qui restreignent la concurrence et contrôlent groupements économiques afin d'accroître l'efficacité économique et d'améliorer les conditions de vie des consommateurs, selon cette loi, le Conseil de la concurrence a été créé en tant qu'autorité administrative indépendante qui s'est vu accorder de larges pouvoirs pour interdire légalement les pratiques arbitraires et punir les auteurs Abstract : The Competition Law is considered the basic building block in the transition from the system that is based on the directed economy to the free market economy system, which aims to liberalize the conditions for practicing competition in the market, avoiding all practices that restrict competition and controlling economic groupings in order to increase economic efficiency and improve the living conditions of consumers, according to With this law, the Competition Council was created as an independent administrative authority that was granted wide powers to legally prohibit arbitrary practices and punish the perpetrators
