Item مدى تأثير صلاحيات رئيس الجمهورية الدستورية الاستثنائية في تقييد الحقوق والحريات (جائحة كورونا نموذجا)(University Centre of Maghnia, 2021-10-10) مروش رميساء تحت اشراف الاستاذة عطار نسيمةالملخص تعتبر الظروف الاستثنائية من أخطر الحالات التي تواجهها الدولة نظرا لأنها تمس بسلامة الدولة واستقرارها ،وفي ظل تطبيق هذه النظرية لابد من اتخاذ إجراءات سريعة واستثنائية لمواجهتها ، وباعتبار رئيس الدولة هو القائد الأول للبلاد فإن الدستور يمنحه صلاحيات جد واسعة في ظل هذه الظروف التي تسمح باتخاذ إجراءات اكثر تقييدا للحقوق والحريات ، ونظرا للانتشار السريع لجائحة كرونا (كوفيد 19) في وقت وجيز مما اثر على حياة الشعوب في عديد من دول العالم، سلّط الضوء على طبيعة الصلاحيات الدستورية الاستثنائية التي تتمتع بها السلطات في الدولة وبالخصوص رئيس الجمهورية ، ومدى إمكانية تطبيقها لمواجهة هذا الفيروس ، وطبيعة الحقوق والحريات الممكن أن تتأثر في هذا الوضع ، مع ضرورة اتخاذ مجموعة من القرارات والإجراءات الاحترازية الوقائية لحماية أرواح الأفراد.
