Item دور التأمين فــي تطور نظام المسؤولية المدنية(University Centre of Maghnia, 2023-06-20) بن علي مهديملخص لقد كان لنظام التأمين من المسؤولية المدنية نتيجة عدة عوامل كالتطور الصناعي والتأمين من حوادث العمل التي تتسم أحيانا بالإلزامية أثر كبير في توسع قواعد المسؤولية المدنية باتجاه حماية المضرور من خلال إعفائه من إثبات خطأ المتسبب في إحداث الضرر وتسهيل حصوله على التعويض، فقد أدى ظهور نظام التأمين إلى تطور المسؤولية المدنية، الأمر الذي ساعد على التخلي تدريجيا على الخطأ كأساس للمسؤولية المدنية مما أدى إلى توسع مجال المسؤولية المدنية. إلا أن نظام التأمين أثر على المسؤولية المدنية من خلال تحريف قواعدها الأساسية التي تقوم عليها، كما أثر على أهم وظائف المسؤولية المدنية.
