الرقابة السياسية على دستورية القوانين في ظل النظام الدستوري الجزائري

Abstract

الملخص: لقد أخذ المؤسس الدستوري الجزائري بآلية الرقابة السياسية على دستورية القوانين وسعى في تطويرها عن طريق الإصلاحات الدستورية، وقد وكل هذه المهمة إلى هيئة سياسية مستقلة عن السلطات الثلاثة في الدولة متمثلة في المجلس الدستوري. وعلى الرغم من أن البدايات كانت نوعا ما غير موفقة من حيث ممارسة المهمة الرقابية في ظل الأحادية الحزبية إلا أن سعي المؤسس الدستوري الجزائري في تطوير المجلس الدستوري من حيث تشكيلته وجهات إخطاره أدى إلى إحداث نوع من التوازن في المعادلة الرقابية وبالتالي كان هناك إلى حد ما تكريس وتفعيل لمبدأ الرقابة السياسية على دستورية القوانين.

Résumé : L’institution constitutionnelle algérienne a adopté un mécanisme de contrôle politique sur la constitutionnalité des lois et a cherché à les développer par le biais de réformes constitutionnelles. Cette mission est confiée à un organe politique indépendant des trois autorités de l’État. Cet organe est représenté par le Conseil Constitutionnel. Même si les débuts ont été néanmoins infructueux dans l’exercice de la fonction de supervision notamment sous l’autorité de la partie unique, des efforts ont été déployés par l’institution constitutionnelle algérienne. Ces améliorations ont touché surtout le développement du Conseil Constitutionnel lui-même en termes de composition .Les parties concernés par les notifications ont été révisées et reconsidérées aussi. Ces changements ont entraîné une sorte d’équilibre bénéfique dans l'équation du contrôle politique sur la constitutionnalité des lois.

Summary : The Algerian constitutional founder has adopted a political oversight mechanism over the constitutionality of laws and has endeavored to develop them through constitutional reforms. This task has been entrusted to a political body independent of the three powers in the state represented by the constitutional council. Although the beginnings were somewhat unsuccessful in terms of the practice of the supervisory task under single-party system, the Algerian constitutional founder’s seeking to upgrading the Constitutional Council in terms of its composition and its notification bodies has led to a kind of balance in the control equation and thus there were, in a sense, consecration and operationalisation of the principle of political censorship over the constitutionality of laws.
