Abstract

ملخص: عرف القضاء الإداري في الجزائر نوعا من الحركية في إطار النظام القضائي الموحد من أجل تحقيق المساواة مع القضاء العادي. ولم يكن ذلك التطور نظريا فحسب،بل ظهر له نوعا من التكريس في الواقع، يتبنى إنشاء القضاء الإداري المفضي إلى انتهاج الازدواجية القضائية. ومادامت الازدواجية تمنح نوعا من الاستقلالية للقضاء الإداري كتنظيم جديد ضمن السلطة القضائية، فقد شمل تنظيمه الهيكلي درجتين من التقاضي هما المحاكم الإدارية ومجلس الدولة، وزعت بحسب التقسيم الإداري المحلي والمركزي. Résumé : La justice administrative a connuun certainmouvementdans le cadre de l’unicité de juridictionafind’acquérirune place égale par rapport aux juridictions a fin de l’ordrejudiciaire. Ce progrès de la justice administrative n’a pas ététhéorique, maisbien plus uneréalité ne pratique. Ce qui a aidél’émergence du système de dualité de juridictionet la miseen place de la justice administrative. Cettenovelleorganisation de la justice administrative donne naissance à deux structures graduées, les tribunauxadministratifs et le conseil d’état. Summary: Administrative justice has been some movement within the jurisdiction of uniqueness to gain an equal place in relation to the courts to end the judiciary. This progress of administrative justice was not theoretical, but rather a practical reality. What helped the emergence of dual jurisdiction system and the establishment of administrative justice? This new organization of administrative justice gives rise to two graded structures, administrative courts and the Council of State.
