Abstract

ملخص: لنظام الإثبات في الدعوى الإدارية خصوصية تميزه عن الإثبات أمام القضاء العادي، لانعدام التوازن بين المراكز القانونية لأطراف الخصومة، حيث نجد الإدارة التي تتمتع بامتياز السلطة العامة كطرف قوي. ومن هنا يأتي الدور الإيجابي للقاضي الإداري بتدخله في تسيير الدعوى الإدارية لأجل تحقيق التوازن، بتحمله قسطا كبيرا من عبء الإثبات، حيث خوله المشرع سلطات واسعة في تقدير قيمة الأدلة، و يعتمد في ذلك طرقا عادية للإثبات وطرقا أخرى احتياطية. : Le système de la preuve dans le contentieux administratif a une spécificité qui le distingue de la preuve devant la justice ordinaire, du fait du déséquilibre entre les centres judiciaires des parties au litige, où l'on retrouve l'administration qui jouit du privilège de l'autorité publique en tant que partie forte, et de là découle le rôle positif et procédural du juge administratif par son intervention dans le déroulement du dossier administratif afin d'atteindre l'équilibre, où il supporte une grande partie de la charge de la preuve, comme le législateur l'a lui a donné de larges pouvoirs pour évaluer la valeur des preuves, et pour cela, il s'appuie sur des méthodes de preuve ordinaires et d'autres méthodes inhabituelles Abstract: The system of evidence in administrative litigation has a specificity that distinguishes it from evidence before ordinary justice, due to the imbalance between the judicial centers of the parties to the dispute, where we find the administration which enjoys the privilege of public authority as a strong party, and from this stems the positive and procedural role of the administrative judge through his intervention in the progress of the administrative case in order to achieve balance, where he bears a large part of the burden of proof , as the legislator has given him wide powers to assess the value of evidence, and for this he relies on ordinary methods of proof and other unusual methods
