آلية تحديد الخطأ المهني ومدى تلاؤم القرارات التأديبية مع الضمانات المقررة للموظف

Abstract

. الملخص قدمنا في هذا البحث دراسة عم الموظف و علاقته بالمؤسسة التي يشتغل بها و الإلتزامات المختلفة التي يتعهد بتنفيذها و مقابل دلك فرض عليه المشرع عقوبات في حالة اخلاله بالتنظيمات و القوانين و هذا ما يسمى بارتكاب الخطأ المهني و لكن رغم القوانين و التشريعات إلا أنها تبقى غير كافية .فالنظام التأديبي السليم لا يكتفي بمجرد الوقوف على الأخطاء و معاقبة مرتكبيها بل لا بدى من دراسة أسباب هذه الأخطاء و الوقوف عليها و من تمى معالجتها لعدم تكرارها مستقبلا . Résumé Dans cette étude, nous avons présenté une étude du travail de l'employé, de ses relations avec l'institution pour laquelle il travaille et des diverses obligations qu'il s'engage à respecter. En contrepartie, le législateur lui a imposé des sanctions en cas de violation des règles et des lois. C'est une erreur professionnelle, mais malgré les lois et règlements, Le système disciplinaire correct consiste non seulement à défendre les erreurs et à punir les coupables, mais également à ne pas commencer à étudier les raisons de ces erreurs et à se défendre ainsi que ceux qui souhaitent y remédier pour qu'ils se reproduisent. Summary: In this research, we presented a study of the employee's work, his relation to the institution he works for and the various obligations he undertakes to implement. In return, the legislator imposed penalties for him in case of violation of regulations and laws. This is called a professional error, but despite the laws and regulations, The correct disciplinary system is not only to stand on the mistakes and punish the perpetrators, but not to begin to study the reasons for these errors and stand on them and those who wish to address them for future recurrence.
