Abstract

الملخص: يعد سند الشحن البحري وثيقة النقل بحرا الذي يمثل الضمان القانوني بين الناقل والشاحن لإيصال البضاعة إلى المرسل إليه، للتطور الحاصل في وسائل الاتصالات بموجب التقنيات الحديثة، فقد تحرر هذا السند عبر هذه الشبكات الإلكترونية بين الشاحن والناقل لإيصال البضاعة إلى المرسل إليه، وبعد هذا السند سند استلام وتسليم البضاعة، عبر قبول هذا السند بالوسائل الإلكترونية، فقد أجازت القوانين الدولية والمحلية إثبات العقد النقل البحري بموجب هذه التقنية على وفق سند الشحن البحري الإلكتروني.

Résumé : Le connaissement maritime est un document de transport qui représente une garantie légale entre le transporteur et l’expéditeur pour la livraison de la marchandise au destinataire en raison du développement des moyens de communisation selon les technologies modernes. Réseaux électronique entre l’expéditeur et le transporteur pour louver la marchandise au destinataire. Et après ce document, la réception et la livraison de la marchandise, en acceptant ce document par voie électronique, les lois internationales et locales ont permis comme preuve du contrat de transport maritime sous cette technologie selon le connaissement électronique.

Abstract: The legal provisions of electronic marine shipping deed according to the information and communication networks the electronically trading works have become more accessible particularly in the contracts of marine shipping and remote transactions contracting until goods are transmitted from seeder to the receiver in according with electronic marine shipping. As advanced state and international organization have tackled the topic in accordance with the traqi legislator, the Iraqi law had to issue legislations that keep pace with the scientific progress in the field of electronic transactions to serve trade generally and regulate the electronic marine shipping deed in particular.
