Abstract

الملخص: يتعلق التنظيم القانوني لمبدأي التناسب والضرورة العسكرية في زمن النزاعات المسلحة بوضع حدود لاستخدام القوة بما يوازن بين تحقيق الأهداف العسكرية وحماية المدنيين. يُلزم مبدأ التناسب الأطراف المتنازعة بعدم تنفيذ هجمات تسبب أضرارًا مفرطة للمدنيين مقارنةً بالميزة العسكرية المرجوة، بينما يجيز مبدأ الضرورة العسكرية استخدام القوة فقط لتحقيق أهداف مشروعة دون تجاوز القواعد الإنسانية. وقد تم تقنين هذين المبدأين في اتفاقيات جنيف لعام 1949 والبروتوكول الإضافي الأول لعام 1977، الذي صادقت عليه الجزائر بموجب المرسوم الرئاسي رقم 89-87 المؤرخ في 6 مايو 1989. ويُعتبر احترام هذين المبدأين ضروريًا للحد من معاناة المدنيين أثناء النزاعات. كما أن انتهاكهما قد يُعد جريمة حرب يعاقب عليها القانون الدولي. Abstract: The legal framework governing the principles of proportionality and military necessity in times of armed conflict aims to impose limits on the use of force in a manner that balances the achievement of military objectives with the protection of civilians. The principle of proportionality obliges warring parties to refrain from carrying out attacks that would cause excessive harm to civilians in relation to the anticipated military advantage. Meanwhile, the principle of military necessity permits the use of force only to the extent necessary to achieve legitimate military objectives, without violating humanitarian rules. These two principles are codified in the 1949 Geneva Conventions and the 1977 Additional Protocol I, which Algeria ratified pursuant to Presidential Decree No. 89-87 dated 6 May 1989. Respect for these principles is essential to minimizing civilian suffering during armed conflicts, and their violation may constitute a war crime punishable under international law.
