السلطة التنظيمية لرئيس الجمهورية في النظام الدستوري الجزائري

Abstract

ملخص إنّ المؤسّس الدستوري أعطى لرئيس الجمهورية الذّي يعتبر قائد السلطة التنفيذية صلاحية ممارسة السلطة التنظيمية في مسائل غير مخصصة للبرلمان، تاركا له بذلك مجالا واسعا يمارس من خلاله اختصاصه التنظيمي منافسا بذلك البرلمان في مجاله التشريعي الذي أصبح مقيّدا ومحدودا فيه ولكن على الرغم من هذه الصلاحية الواسعة والسلطة المطلقة إلّا أنّ كلّا من التنظيم والقانون يخضعان للرقابة الدستورية والقضائية في حال تعدّي أحدهما على الآخر.
