الدفع بعدم دستورية القوانين دراسة مقارنة

Abstract

الملخص: تعد آلية الدفع بعدم الدستورية نقلة نوعية لتحقيق العدالة، حيث يجعل المواطن في قلب معادلة تحصن حقوقه وحرياته كما تمكن القضاء من المساهمة في تحريك الرقابة على دستورية القوانين من خلال المحكمة الدستورية في ظل القانون العضوي رقم 22-19 وذلك بوضع نظام قانوني يضبط كيفية ممارسة آلية الدفع، وهو ما قامت به الأنظمة القانونية محل الدراسة وتحديد الشروط التي أقرها المشرع الجزائري للدفع بعدم الدستورية ومقارنتها بالأنظمة الأخرى(الفرنسي-المصري) لتحديد أوجه الاتفاق والاختلاف التي قد تساهم في تصحيح المسارات الخاصة بتعزيز الحقوق والحريات. Résumé : Le mécanisme de défense de d'inconstitutionnalité constitue un saut qualitative dans la réalisation de la justice, plaçant le citoyen au cœur de l'équation de protection de ses droits et libertés. Ce mécanisme permet également à la justice de contribuer à l'activation du contrôle de constitutionnalité des lois par le biais de la Cour constitutionnelle, conformément à la loi organique n° 22-19, en établissant un cadre juridique régissant les modalités de mise en œuvre de ce mécanisme. C'est ce qu'ont réalisé les systèmes juridiques étudiés, en précisant les conditions fixées par le législateur algérien pour l'exception d'inconstitutionnalité et en les comparant avec d'autres systèmes (français et égyptien) afin de déterminer les points de convergence et de divergence susceptibles de contribuer à la correction des démarches visant à renforcer les droits et libertés. Abstract : The mechanism of defending is a qualitative leap in achieving justice, placing the citizen at the heart of the equation to protect their rights and freedoms. It also enables the judiciary to contribute to activating the control of the constitutionality of laws through the Constitutional Court, under Organic Law No. 22-19, by establishing a legal framework that regulates the exercise of this mechanism. This approach has been adopted by the legal systems under study, specifying the conditions set by the Algerian legislator for the unconstitutionality plea and comparing them with other systems (French and Egyptian) to identify the similarities and differences that may help in correcting the paths to enhancing rights and freedoms.
