تطبيقات نظرية الظروف الاستثنائية وآثارها على ممارسة الحريات العامة

Abstract

الملخص لرئيس الجمهورية في ظل الظروف الاستثنائية سلطات واسعة وغير مألوفة تفوق تلك التي يتمتع بها في الظروف العادية،فالكثير من الإجراءات التي لا يجوز اتخاذها في الظروف العادية تصبح مشروعة في الظروف الاستثنائية ونظرا لما لهذه السلطات من أثار على الحريات نص التعديل الدستور لسنة 2020على شروط معينة ينبغي على رئيس الجمهورية التقييد بها عند ممارسة سلطته في إعمالها. Résumé: Le président de la république jouit ,à titre exceptionnel, de pouvoirs étendus et méconnus qui dépassent ceux dont il jouit dans des circonstances normales. Le président de la république doit s’y conformer dans l’exercice de son autorité dans ses affaires. Abstract : Under exceptional circumstance ,the president of the republique has broad and unfamiliar powrs beyond those in normal circumstance ,so many actions that cannot be taken under normal circumstance become legitimate in exceptional circumstances ,and in view of the effects of these powers on freedoms, the 2020 constitution stipulates certain condition that the president of the republic should observe in exercising his authority in their actions.
