Abstract

الملخص: يعتبر موضوع المسؤولية المدنية للطبيب أثناء التدخل الطبي؛ من أهم مواضيع المسؤولية المدنية الملقاة على عاتق الطبيب وأركانها، وكذا طبيعة تلك المسؤولية وطبيعة التزامات الطبيب، والذي تقتضي تحديد المسؤولية المدنية. كما للطبيب أن يعفى من المسؤولية إذا توافرت أسباب الاعتقادات العام وكذا الخاصة، كما أن للمسؤولية المدنية آثار تتمثل في تعويض المتضرر عن ما لحقه من ضرر جراء التدخل الطبي ،كما ألزم المشرع الطبيب بالتأمين من المسؤولية.
