نظام الوقف في القانون الجزائري

Abstract

الملخـــــــــــص لقد كان الوقف ومازال من أهم النظم الأولى في الشريعة الإسلامية ، فقد ساهم بجلاء في تحقيق التنمية الاقتصادية و الاجتماعية ، وشكل من خلال خصائصه، ومرونة أحكامه حقلا خصبا للابتداع الإنساني في مجال توفير المنافع و الخدمات و الأعمال الخيرية. إلا أن هذا الدور تراجع بشكل كبير نتيجة للممارسات الخاطئة على الأوقاف من قبل العاملين على الوقف أو من الذين استغلوه لمصالحهم الشخصية فأدى به إلى ضعف التراكم الرأس مالي الوقفي، مما استدعى إلى ضرورة الاهتمام به لإعادة دوره الاجتماعي و الاقتصادي ليحقق ما هو مطلوب منه ، فالجهود التي بذلها المشرع الجزائري لم توفق إلى حد ما بسبب صعوبة الحصر الشامل للأوقاف و تسجيلها ، و كذا بسبب العديد من التجاوزات التي تتعرض لها الأوقاف من تعدي مما يستدعي الاهتمام أكثر بالممتلكات الوقفية في الجزائر. Mais ce rôle a fortement baisse en raison des pratique de la mauvaise sur la dotation par les travailleurs sur la cessation ou qui astgloh intérêts personnels l’a conduit a la faiblisse de l’accumulation de la dotation en capital ; qui appelle a la nécessite de prêtes attention a nouveau rôle social et économique a réaliser ce qui est exige de lui. Les efforts déployés par le législateur algérien n’a pas réussi dans une certaine mesure en raison de la difficulté inventaire complet des awqaf et enregistrées ; ainsi que en raison des nombreux abus dotations exposes de pillage et de vandalisme ; qui appelle a une plus grande attention aux fpl de propreté en Algérie. abstract The waqf ; which is still one of the most important systems in islamic law ; has clearly contributed to economic and social development ;and through its characterics ans the flexibility of its provision constituted a fertile field for human creativity in the provision of benefits ; services and charitable works. However ; this role declined significantly due to the wrong practices on endowment by the employees of the waqf or thosewho exploited them for their personal intersts led to the weakness of capital accumulation ;which calls for the need to pay attention to it to restore its social and economic role to achieve what is required of it. The efforts made by the algerian legislator did not succeed to some extent due to the difficulty of the comprehensive inventory of waqf and its registration ; as well as because of many of the abuses that endowments are subjected to infringement ; whicg callsfor more attention to property waqf in algeria
