Abstract

الملخص اكتسبت ظاهرة اللجوء اهتماما كبيرا من قبل المجتمع الدولي، وهذا من خلال مختلف النصوص القانونية والاتفاقيات الدولية والإقليمية، والتي أعطت مفهوم واضح للاجيء مختلف عن المفاهيم المشابهة له، كما نصت على حقوقه والتزاماته وكذلك حقوق والتزامات دولة الملجأ، كما تم خلق آليات خاصة لتوفير الحماية القانونية للاجيء عن طريق مجموعة من اللجان مثل المفوضية السامية لشؤون اللاجئين واللجنة الدولية للصليب الأحمر، غير أن هذه الجهود تبقى غير كافية بسبب عدم امتثال الدول لها، وعليه ينبغي على المجتمع الدولي إيجاد الحلول المناسب لحماية اللاجئين. Le résumé : Le phénomène de l’asile a suscité une attention significative de la part de la communauté internationale à travers les divers textes juridiques et les conventions internationales et régionales qui ont donné un concept plus clair du réfugie, différent de concepts similaires. Ils stipulent également les droits et les obligations du réfugie, ainsi que ceux du pays d’accueil. Des mécanismes spéciaux ont également été créés pour fournir une protection juridique aux réfugies par l’intermédiaire d’un certain nombre de comités, tels que le Haut- Commissariat des Nations Unies pour les réfugies et le Comité International de la Croix-Rouge. Cependant, ces efforts demeurent insuffisants en raison du non-respect de ces textes par les pays. La communauté internationale doit donc trouver des solutions adéquates pour protéger les réfugies. Summary : The asylum phenomenon has obtained considerable attention by the international community. This is through the different legal texts, as well as the international and regional conventions, all of which gave the refugee a clear concept that differs from other similar concepts. In addition to the stipulation of rights and obligations for both the refugee and the country of asylum. Moreover, special mechanisms were launched for the purpose of providing the refugee with legal protection through a group of committees, such as the United Nations High Commission for Refugees )UNHCR(, and the International Committee of the Red Cross )ICRC(. However, these efforts remain inadequate due to the nations’ non-compliance. Therefore, the international community ought to find appropriate solutions to protect the refugees.
