Abstract

ملخص تنقسم المسؤولية القانونية لطبيب التجميل إلى مسؤولية مدنية ومسؤولية جزائية، بحسب طبيعة الخطأ والضرر الناتج عنه في إطار المسؤولية المدنية، حيث يُحدد أساس الالتزام الطبي بصفته التزاما ببذل عناية، مع التركيز على تمييز هذه المسؤولية عن غيرها بالنظر إلى خصوصية العمل التجميلي الذي لا يقوم غالبا على ضرورة علاجية. ويترتب على الإخلال بهذا الالتزام، التزام الطبيب بالتعويض، مع إمكانية تغطية ذلك من خلال التأمين الطبي. أما المسؤولية الجزائية فتقوم عند ثبوت الخطأ الموجب للعقوبة، بشرط توافر القصد الجنائي أو الإهمال الجسيم، حيث يُلقى عبء الإثبات على النيابة العامة أو المريض المضرور، ويُستعان في ذلك بطرق فنية وقانونية لإثبات الخطأ والعلاقة السببية بين التصرف الطبي والنتيجة الإجرامية. Abstract : The legal liability of a cosmetic surgeon is divided into civil and criminal liability, depending on the nature of the error and the resulting harm. In terms of civil liability, the basis of the medical obligation is defined as an obligation to exercise due care, with emphasis on distinguishing this liability due to the particular nature of cosmetic procedures, which are often not medically necessary. A breach of this obligation results in the physician’s responsibility to compensate the patient, with the possibility of covering the damage through medical insurance. As for criminal liability, it arises when a punishable error is proven, provided that criminal intent or gross negligence is established. The burden of proof lies with the public prosecutor or the injured patient, and technical and legal methods are employed to establish the error and the causal relationship between the medical act and the resulting criminal outcome.
