سلطة ضبط البريد والإتصالات الإلكترونية بن الإستقلالية والرقابة القضائية الإدارية

Abstract

بموجب القانون 2000-03 أنشئت سلطة ضبط البريد و المواصلات السلكية و اللاسلكية. و بموجب القانو04 أصبحت هذه الأخيرة تسمى سلطة ضبط البريد و الاتصالات الالكترونية. فهي هيئة إدارية وطنية منفصلة عن المصالح المركزية للدولة، مختصة أساسا في تنظيم المنافسة داخل سوقي البريد و تكنولوجيات الإعلام و الاتصال و الرقمنة، و ذلك عن طريق ممارسة وظائفها الأساسية المتمثلة في: التنظيم،الرقابة،اقتراح آراء و توصيات، و كذلك اتخاذ قرارات و فرض عقوبات لفض النزاعات التي قد تثور ما بين: إدارتي القطاعين، أو ما بين الإدارتين و متعامليهما، أو ما بين المتعاملين فيما بينهم. و نشاط هذه الهيئة في حد ذاته معرض لرقابة قضائية. فقد تكون قراراتها محل طعون قضائية. Abstract : Under Law 2000-03، the postal and télecommunictions control Authority was established. Under Law 18-04، the latter became known as the Authority for the control of Electronic Mail and Communications. It is a national administrative body separate from the central interests of the state، mainly concerned with regulating competition within the postal and digitizingmarkets through the exercise of its basic functions of organizing،controllling،proposing opinions and recommendations ، which may arise between : the administrations of the sectors،، the administrations of the sectors and their clients، or betxeen the dealers among themselves.The activity of this entily itself is subgect to judicical review.
