الرقابة على الأعمال المجلس الشعبي الولائي في النظام الجزائري

Abstract

الملخص : إن المجلس الشعبي الولائي يعتبر أهم جهاز في الولاية نظرا لأنه هيئة مداولة ،و يشكل الأسلوب الأمثل للقيادة الجماعية من قبل المنتخبين . ولقد خص المشرع الجزائري المجلس الشعبي الولائي بعدة نصوص قانونية من اجل تعزيز عمل تشكيلته المنتخبة من جهة و تحديد صلاحياته واختصاصاته من جهة ثانية . من خلال هذا العمل سوف نقوم بتسليط الضوء على المراحل التي مر بها تشكيل المجلس الشعبي الولائي في الجزائر وكيفية عمله و اختصاصه و صلاحياته في ظل الرقابة المفروضة على أعماله وعلى أعضاءه من قبل الجهاز التنفيذي المركزي والمحلي، ومدى تأثير هذه الرقابة على استقلالية عمل المجلس الشعبي الولائي وأعضائه خلال العهدة الانتخابية.

Résumé L’assemblée populaire de la wilaya (APW) est l’orge le plus important a la wilaya car il s’agit d’un orange délibérant constituant la meilleure méthode de guidance collective par les élus. Le législateur algérien a régit l’assemblée populaire de la wilaya par les nombreux textes de loi afin de renforcer sa constitution électorale d’une part et déterminer ses compétences d’autre part. Par notre présente étude nous tentons de mettre en lumière les étapes de constitution de APW en Algérie ; ses méthodes de fonctionnement ; ses compétences et prérogatives dans le cadre du contrôle de ses travaux et de ses membres par les organes exécutifs centraux et locaux ; et l’impact de ce contrôle sur l’Independence du travail de l’APW et c’est membres élus durant sons mandat électoral.

-Commissions-dél ibérations Abstract The Wilaya people’s Assembly (APW) is the most Important devise in the Wilaya because it is a deliberative body constituting the best method of collective guidance by elected officials . The Algerian legislature has governed the people’s Assembly of the Wilaya by several laws in order to strengthen its electoral constitution and to determine its competences. Our present study attempt to highlight the stages of APW’s establishment in Algeria, its methods of operation, its powers in the control of its work and its members by the central and local executive bodies ,and the Impact of this control on the independence of the elected representative’s work during his electoral mandate and the people’s Assembly of Wilaya.
