المسؤولية المدنية للطبيب عند الخطأ في تحرير وصفة طبية

Abstract

الملخص: لا يزال موضوع مسؤولية الطبيب بمختلف جوانبه وتعدد مضامينه يستأثر بمزيد من البحث والدراسة، إذ حظي تخصص القانون الطبي عموما وقضايا مسؤولية الطبيب خصوصا باهتمام بالغ لارتباطها الوثيق بالصّحة البشرية سعيا لتحقيق التّوازن لطرفي العلاقة الطّبيّة وذلك بحماية حقوق الطّبيب وحقوق المريض من الأخطاء الطّبيّة الّتي من شأنها المساس بسلامته، بحيث ينتج عن الخطأ في تحرير وصفة طبّيّة قيام مسؤولية مدنية متى توفّرت أركانها بهدف حصول المريض على تعويض بعد اثبات الخطأ الّذي يترتّب عنه ضرر. Résumé: La responsabilité du médecin avec ses différents aspects et ses contenus multipliés demeure un sujet qui représente davantage de recherche et d’étude. Le domaine du droit médical en général et notamment de questions de responsabilité du médecin fait l’objet de l’attention vu son lien étroit avec la santé humaine dans le but de rétablir l’équilibre à la relation médecin-patient en protégeant les droits du médecin et ceux du patient des erreurs médicales qui peuvent mettre la vie du patient en danger de sorte qu’une responsabilité civile est mise en œuvre suite à l’erreur du médecin en prescrivant une ordonnance tant que ses conditions sont prouvées afin de garantir le droit de la personne lésée à l’indemnisation. Abstract: Medical liability with its different aspects and various contents remains a subject of research and study. Consequently, a great importance was given to both the domain of medical law in general and the issues of medical liability in particular as they are strongly related to human health in order to achieve balance for both medical relationship parties by protecting the doctor’s rights on one side and the patient’s rights, on the other side, from medical errors that may end anger his safety because a mistake in writing a prescription results a civil liability when everits constituent parts are provided to enable the patient from an indemnity after proving the domage.
